The Order partly amends Order No. 94, in particular the deadline and means for applying for subsidy – whereby the application must be submitted electronically and in adherence to Commission Delegated Regulation (EU) No. 640/2014 of 11 March 2014. The Order repeals articles 25, 25a-25f, 30 and 39. A new Chapter (6a) is inserted and provides rules on the decrease of subsidy in adherence to article 35 of Commission Regulation No. 640/2014 of 11 March 2014. There will be no payment of subsidies for areas mentioned in article 32, section 2b of Regulation (EU) No. 1307/2013.

The Act partly amends the Planning Act (inserting a new article 5, repealing art. 15, section 2, No. 22) and the Nature Conservation Act (inserting a new article 65a, and sections in article 78) with regard to experimental provisions for coastal and nature tourism activities and repealing the opportunity to plan for low-energy houses in local plans thereafter.

This Order establishes additional provisions related to the Farms Act. A farm/land property can be registered as such and notification thereof shall be submitted to the Survey and Cadastre Authorities to ensure proper residency status. Provisions also include companies in other EU countries or countries that have signed the Agreement on the European Economic Area (EEA). It is compulsory that these companies are registered with a branch office operation.

This Act introduces the Scottish Landfill Tax as the replacement for UK Landfill Tax in Scotland. The Scottish Landfill Tax is a tax which is charged on taxable disposals. The Act defines what a taxable disposal is (A “taxable disposal” is waste material which has been disposed of by way of landfill), and prescribes, among other things, what disposals are exempt from the tax, how to calculate tax, who is liable to pay tax and when credit is available in relation to tax.

This Order prescribes landfill site activities for the purposes of section 6 of the Landfill Tax (Scotland) Act 2014. These activities will be treated as disposals and will be subject to Scottish landfill tax. In addition to listed activities, an activity is prescribed if it gives rise to a requirement: (a) for notification or the giving of information under section 31 of the Act (information: site restoration); or (b) imposed by Regulations under section 30 of the Act, and that requirement is not complied with.

The Act concerns District Councils and local government in Northern Ireland. It also provides with respect to community planning and some matters regarding governance.The Act makes provision with respect to discharge of functions of Councils. A council's functions with respect to acquiring or disposing of land may only be discharged by the Council itself. The Act also provides for permitted forms of governance such as a committee system or executive arrangements or prescribed arrangements (as defined).

This Order, made under sections 13(4) and 14(7) of the Landfill Tax (Scotland) Act 2014 defines material (listed in column 2 of the Schedule) as qualifying material for the purposes of the lower rate of Scottish landfill tax. Such materials are described and conditions as to their state specified alongside. Conditions as to their use are specified in provisions of the Order.

These Regulations, made under sections 15, 18, 19, 20, 22(9), 23, 25, 30, 32 and 37(1) and (4) to (7) of the Landfill Tax (Scotland) Act 2014, make provision for the administration and assurance of Scottish landfill tax. They regulate the registration of persons who intend to make taxable disposals and provide for the making of returns. An entitlement to credit shall be granted in circumstances relating to the recycling, incineration and permanent removal of waste.
