Republican Resolution on Law No. 39 of 1991 on the Land Register.

This Resolution is composed of 37 articles. Terms and definitions are given in article 1. Lands shall be divided into 3 parts: public lands, private lands and endowment lands (art. 2). There shall be two systems for land registration: individual and corporate body (art. 3). The inheritance right shall be written if it includes a land (art. 10). Rent contracts which exceed 5 years shall be registered in the appropriate newspaper (art. 13). Articles 20-26 deals with dispute settlements. The Prime Minister shall issue the Regulation for registration fees (art. 33).

This Regional Law establishes legal land economic grounds for state regulation of soil fertility of agricultural land. The Regional Law consists of 6 Chapters. This Act establishes and regulates the Land Court, it consists of 94 sections and is divided into six Parts. The Act also establishes a Land Appeal Court, specifies its jurisdiction and operation. Both courts are the continuance of the courts established under the Land Act 1962 and preserved in existence by the Land Act 1994 (Part 6).

Land Transfer Tax Act (R.S.O. 1990, c. L.6).

This Act concerns the taxes related to the transfer of land. It covers assessment of taxes, their registration, collection and refund. Under section 9, records of every person required to file an affidavit or deliver a return under section 5 shall keep at their principal place of business documents, records and accounts in such form and containing such information as will enable an accurate determination of the taxes payable under this Act. Other provisions concern investigation (sect. 10), appeals (sect. 14), lien on real property (sect. 15) and dispute resolution (sect. 20).

This regulation implements the Assessment Act. It contains provisions related to the classes of real property (Part II) and to subclasses of real property (Part III). It specifies what constitutes conservation land and the related tax exemption provisions (Part IV). It provides for the settlement of disputes related to the managed forests property class (Part VI) and of disputes relating to conservation land (Part VII). This Law is an integral part of urban construction and environmental legislation of the city of Moscow and establishes the modalities of planning, regulation and carrying out urban construction activity on the territories of natural complex of the city of Moscow. The document consists of 13 Articles. Article 1 introduces the principal concepts. Article 2 establishes the legal basis for the regulation of urban construction activity on the territories of natural complex. Article 3 regards land use planning for the territories of natural complex.

Expropriation Act (R.S.Y. 2002, c. 81).

This Act concerns the expropriation of land, which includes “any estate, term, easement, right or interest in, to, over or affecting land” (sec.1). Under section 2, the Minister has the power to expropriate any land he or she deems necessary for public purposes. The Act provides for compensation for disturbance, injurious affection of land or expropriation to be assessed and paid. Section 13 provides for the establishment of a Board of negotiation to solve disputes related to expropriation.

Zoning Appeal Board Regulation (Y.C.O. 1976/225).

This regulation implements the Area Development Act by establishing the Zoning Appeal Board, regulates its membership and operation. Under section 15, the Board has the same powers and privileges as are granted to a Judge for summoning and compelling attendance of witnesses, administering oaths to witnesses, and calling for the production of documents.
