This Act makes provision for administration and enforcement in relation with the presence of hazardous substances in or over land.Various public bodies are appointed as authorities at state and local level for purposes of this Act. The Act prescribes that the presence of a hazardous substance on, over or under land requires the consent of the hazardous substances authority. For the purposes of this Act the Secretary of State shall by Regulations specify: (a) the substances that are hazardous substances; and (b) the quantity which is to be the controlled quantity of any such substance. The Act defines offences and defines the power to issue hazardous substances contravention notice by a hazardous substances authority.
