This Act regulates the manufacture, processing and importation of fertilizers for marketing purposes. It does not apply to sewage sludge, "technically unprocessed natural fertilizers" , etc. (sect. 1).The text consists of 31 sections divided into 7 Chapters: General part (I); Fertilizer register (2); Quality of fertilizers and attestation of conformity (3); Manufacture, processing and importation for marketing purposes (4); Supervision, quality control and marketing of sub-standard fertilizers (5); Liability of suppliers (6); Implementing provisions (7).Section 2 defines "fertilizers", "mineral fertilizers", "organic fertilizer", and "soil amendment". The Fertilizer Register contains data on fertilizers in Estonia and is maintained by the Plant Protection Inspectorate in accordance with section 4. The information to be entered in the Register is specified in section 6. Additional information shall be submitted to the Registrar in accordance with section 7. A certificate of registration shall be issued in accordance with section 8. Chapter 3 concerns the examination of quality of fertilizers by "Attestation Bodies" approved by the Minister of Agriculture in accordance with sections 12 to 14. The Attestation Body shall issue a certificate of conformity with requirements described in subsection 1 of section 12. Chapter 4 lays down rules relative to production, importation, packing (sect. 18), and marking (sect. 19) of fertilizers. Only registered fertilizers may be manufactured, imported or processed. The Plant Production Inspectorate shall be the principal supervisory authority for purposes of this Act. The Minister shall establish procedures for taking samples of fertilizers, testing of samples, etc. Section 22 concerns quality inspection carried out by an approved Attestation Body, whereas section 23 deals with internal routine control. Chapter 6 provides for sanctions in accordance with the Code of Administrative Offences.
