Law No. 17 of 1974 on the management of public land.

This Law is composed of 22 articles: management of public land is to be entrusted to the Director-General of Land Department (art. 3); competencies of Public Land Committees (art. 5); recommendations for land tenure and rent will be promulgated by the High Committe (art. 6); public land lease is to be authorized by the Minister of Finance (art. 7); leasing priorities: agriculture and housing (art. 8); the implementing regulations will be promulgated by the Cabinet (art. 19); Laws Nos. 14 of 1972 on forest reclamation and No. 9 of 1968 are now abrogated (art. 20).

Cette loi établit le régime relatif aux immeubles domaniaux agricoles. Elle comprend 33 articles répartis en 5 chapitres, à savoir: Dispositions générales (I); Exploitation des immeubles domaniaux agricoles (II); Aliénation en vue de la régularisation d'anciennes situations foncières (III); Echange (IV); Dispositions communes (V).

Arrêté des ministres de l'agriculture et de l'équipement et de l'habitat du 31 octobre 1995, fixant les superficies minimales des exploitations agricoles et celles maximales des constructions pouvant y être édifiées.

Cet arrêté fixe les conditions requises pour pouvoir édifier un bâtiment dans les exploitations agricoles, à savoir: le permis de bâtir, la superficie de l'exploitation qui ne doit pas être inférieure à 1 hectare, la superficie couverte réservée aux bâtiments d'habitations qui ne peut pas dépasser 1500 mètres carrés auxquels peuvent s'ajouter 50 mètres carrés par ouvrier permanent ou coopérateur. Toute autre construction ou ouvrage non destiné à l'habitat, est soumise à l'autorisation préalable du Ministre de l'agriculture.

Every person who desires to undertake a development project must obtain a planning permission from the Authority before undertaking the development (comma. 1 of reg. 5). For purposes of paragraph 1, development projects shall be classified in accordance with paragraph 2 of regulation 5. Each application shall be accompanied by appropriate plans (comma. 1 of reg. 6). An application for a planning permission is not necessary for the development of land for agricultural purposes or for forestry (reg. 8).

El Decreto, que consta de 9 artículos, aprueba el Plan de uso del suelo para el Departamento de Santa Cruz. El plan establece las siguientes categorías generales de uso: a) tierras de uso agropecuario intensivo; b) tierras de uso agropecuario extensivo; c) tierras de uso agrosilvopastoral; d) tierras de uso forestal; e) tierras de uso restringido; e) áreas naturales protegidas (art. 2º).

The intention of the Law is to allow acquisition of title to agricultural land as compensation for property loss as a result of State intervention in the past, considering the interest in continuous agricultural development as well. Article 1 lays down deadlines for the presentation of claims for agricultural land against compensation coupons. Assignment procedures for compensation coupons are covered by Articles 2 and 3. The implementation of the Law is remitted to land redistribution commissions (art. 4). Such commissions propose auction schemes and land to be sold by auction.

Legal and natural persons using at least fifty acres of agricultural land are compelled to keep a plot register where they report every happening relative to plots of fields, gardens, orchards, grasslands and reeds. Registers also include data regarding ownership, geographical area, agrochemical, geological and climatic features of the plot. The control of plot registers is performed by county (capital) plant protection and soil conservation stations.

The Act makes provision for private, collective, and state property. The text consists of 25 articles divided into 5 Parts: General Regulations (I); Citizens' Property (II); Collective Property (III); The State Property (IV); Guarantees, Protection and Restrictions of the Proprietary Rights (V).The right of ownership, is recognized and protected by law (art. 1). Article 2 lists the objects of the right of ownership. Also persons not admitted to the citizenship of the Kazakh SSR may be subjects of the right of ownership (art. 3).

The agricultural lands owned by the State, burdened with the right of "disposal" of persons who personally or through others cultivated it, according to the "agricultural density" decided for them, shall be considered as owned by the state without compensation and shall be registered in the name of the Ministry of Finance as a pure property and the Ministry of Agriculture shall dispose of such lands in accordance with Laws and Resolutions in force (comma A of par. 1).
