These Rules prescribe the procedure to be followed in connection with local inquiries relating to applications for planning permission or for the approval of a local planning authority required under a development order held by the Secretary of State in England, where he or she thinks that the development to which the application relates is of national or regional importance. The Rules have been made in consequence of the enactment of the Planning and Compulsory Purchase Act 2004 which inserted new sections 76A and 76B into the Town and Country Planning Act 1990.

This Order amends the Town and Country Planning (General Development Procedure) Order 1995 ("the 1995 Order") in consequence of provisions in the Planning and Compulsory Purchase Act 2004. It also makes certain other minor amendments, i.e.

Land Compensation Act 1961 (1961 Chapter 33 9 and 10 Eliz 2).

This Act makes provision for assessment of compensation in respect of compulsory acquisitions of interests in land and related matters such as procedures at the Lands Tribunal for assessing compensation in respect of land compulsorily acquired and regulatory powers of the Secretary of State. It also concerns assumptions in respect of certain land comprised in development plans.

These Regulations amend the Town and Country Planning (Development Management Procedure) (Scotland) Regulations 2008 in relation with historic battlefields. A new inventory of such areas shall be compiled and the planning authority shall consult the Scottish Ministers in certain cases where an application for planning permission is made for development which may affect a historic battlefield.

This Act provides with respect to the acquisition of land on the basis of a resolution of Tynwald for public purposes and compensation in relation with such acquisition. It, among other things, sets out the procedure for authorising compulsory purchase; requires disputes to be solved by an established procedure which includes arbitration; provides for acquisition by agreement; purchase or redeem of the interest of the mortgagee of any of the land; presumption of planning approval (also in respect of land used for agricultural purposes).

The purpose of these Regulations is to strengthen the protection and management of forest lands, and rationally develop and utilize forest land resources. The Regulations consist of 7 Chapters: General provisions (I); Land tenure management (II); Protection and utilization of forest lands (III); Expropriation and occupation (IV); Legal liability (V); Supplementary Provisions (VI).The forest lands are under the State ownership and collective ownership. The forest lands owned by the State or owned by collectives, may be used by the entity or individuals for forestry production.

These Regulations implement Council Directive 85/337/EC on the assessment of the effects of certain public and private projects on the environment, as amended by Directive 97/11/EC. The main changes made by Directive 97/11/EC, which these Regulations implement, are as follows. The number of categories of project subject to environmental impact assessment (EIA) is increased. An individual determination on whether EIA is required must be made in respect of every project in Annex II to the Directive (Schedule 2 to these Regulations) which exceeds thresholds established by a Member State.
