This Decree has been enacted in order (i) to control the utilization of land in general; (ii) to settle the problems in the field of land affairs; and (iii) to review the position, tasks, and functions of the Directorate General of Agrarian Affairs, and to upgrade it to an institution which handles land affairs on a national level: the National Land Affairs Agency. This is a non-departmental government institution which is positioned under the President of the Republic.

Le présent décret, ayant pour but de protéger l'environnement contre la pollution due à la production et à l'utilisation d'engrais, règle une matière visée à l'article 107 quater de la Constitution. D'abord, sont définis certains termes comme "terre", "terre arable", "bétail", "entreprise", "engrais", "engrais animal", "bilan nutritif", "producteur", "transporteur", etc. L'article 3 établit que le producteur doit fournir chaque année à la "Mestbank" des éléments énumérés dans l'article 3.

The present Act makes arrangements relating to lands in Forest Areas. Such lands shall be sold by the appropriate authority to peasants who have "settled down there and who have been cultivating the lands for at least one year past..." (art. 4(1)). Land left over after sale and distribution as described above shall be sold or distributed in the prescribed manner. Further provisions concern the registration of lands, the modalities for the payment of the price of the land by the allottee and enforcement measures.

The object of the Act is to provide a system for the registration of title to land and interests in land.

Regulations to provide for the registration of titles to land and dealings with registered land.The 136 regulations are divided into 6 Parts: First registration (I); Adjudication procedure (II); Dealings with registered land (III); Minor entries in the register (IV); Fees (V); Miscellaneous (VI). The regulations are completed by 3 Schedules. The First Schedule contains no less than 53 forms applications, notices, deeds of transfer, summons, etc.

The functions of the Department of Land and House Management are related to the control of the uniform implementation of land and house management legislation and guiding principles. Within said framework, the Regulation establish functions and rights of the Department of Land and House Management (among others, cadastral control, mediation activity among disputing parties, management of the personnel, etc.).

The 22 sections of this Act are divided into 5 Parts: Preliminary (I); Strata Lots (II); Corporations (III); Registration and Dealings (IV); Management and administration (V).

The Registrar of Titles shall keep a register of strata plans and shall record therein particulars of all strata plans lodged in his office for registration pursuant to the Act (reg. 3). Regulation 4 prescribes the mode of preparation of composition of strata plans. Regulation 15 provides for the registration of transfer of titles, regulation 16 for the registration of a lease, and regulation 17 for the registration of an easement or restricting covenant.

Cette loi porte organisation de la propriété foncière. A cette fin elle institue un service dit de la conservation foncière, chargé d'assurer aux titulaires la garantie des rôles réels qu'ils possèdent sur ces immeubles, et ce au moyen de l'immatriculation de tous les immeubles aux livres fonciers et la publication sur les livres fonciers de tous les droits réels qui s'y rapportent. L'immatriculation est obligatoire et définitive. Sont considérés immeubles par l'objet auquel ils s'appliquent: les droits réels immobiliers et les actions qui tendent à revendiquer un immeuble.

Le champ d'application des lois relatives au régime foncier, domaine public de l'Etat nº 171/AN/91, domaine privé de l'Etat nº 173/AN/91, propriété foncière nº 177/AN/91 est limité au périmètre urbain de l'agglomération de la ville de Djibouti.

Cet arrête fixe la tarification des actes soumis à la publication au bureau de la conservation foncière.

Ce décret porte création, attributions et organisation du bureau de la conservation foncière, chargé de garantir, à partir de leur publication dans les livres fonciers, tous les droits réels s'y rapportant, ainsi que les modifications de ces mêmes droits.
