The present Law lays down provisions relating to farming land and gardens. Article 1 establishes that a Farming Land Commission shall be nominated. The present Ordinance enforces the Land Use Planning and Building Law of 14 May 1987. Land consolidations shall be effected in view of building land, land not designed as such shall be re-allocated. The text deals with the following aspects: definition of terms, sphere of application, cooperatives, purpose of land consolidation, survey, principles of allocation, costs, administrative proceedings, legal protection and entry into force. This Act establishes a Land Survey Board under section 3. The Board shall be chaired by a Director of Surveys, the duties and functions of which are set out in section 11.Responsibilities of the Board are set out in section 5. The Director of Surveys shall be the custodian of the Survey Register in which surveys shall be entered (sect. 14). Other provisions of this Act concern qualification and registration of land surveyors and the practising of their profession.

Oil Mining (High Water Mark) Act (Cap. 62:03).

This Act provides certain rules relative to surveys related to the determination of the high water mark, required for the establishment of rights relating to the drilling for oil in the land and marine areas within five hundred feet of high water mark. The Chief Petroleum Engineer, the Commissioner of State Lands and any adjacent owner who objects to the high water mark as defined in a survey plan may apply to court to declare what is the high water mark.

This Order establishes requirements for land surveying projects of the plots of land. Land surveying project shall be approved by: (a) common decision of the assembly of land shareholders for agricultural land; and (b) decision of the owner of a land share or land shares. Land surveying project determines the boundaries of land plots and land shares and includes data of collective (common) land ownership and municipal land ownership. Land surveying project shall be validated by land cadastre engineer. Annex 1 contains the form of recommended model land surveying project.

These Regulations, in implementing provisions of the Land Surveyors Act, make further provision for registration and qualification of land surveyors and establish rules for carrying out land surveys. Regulations 3 to 5 specify qualifications, whereas regulation 6 concerns registration. A Code of Ethics is laid down in the Third Schedule. Regulation 25 and following contain rules on the carrying out of surveys and the drawing of up land survey plans.

This Notice requires a surveyor duly licensed as a surveyor under or by virtue of the provision of the Survey Act to always maintain the high standard of conduct appropriate to his or her professional status, and not conduct himself or herself in a manner that would, in the opinion of the Land Surveyors Board prejudice that status or the reputation. It also prohibits conduct of incompatible business and prescribes some other rules of conduct.

These Regulations implement provisions of the Survey Act with respect to the Land Surveyors Board, the Standing Committee on Geographical Names, the examination and issue of licences, land survey operations, government land surveys and resolution of disputes. The Regulations also provide for the reservation of land in case of survey for purposes of alienation of government land in coastal areas and near to lakes or tidal rivers.

For the purpose of the present Law “Iinfrastructure for spatial information” means metadata, spatial data sets and spatial data services; network services and technologies; agreements on sharing, access and use.

These Regulations specify, in the Schedule, the qualifications that shall be the appropriate qualifications for the purposes of section 5(1)(b)(ii) of the Land Surveyors Act. That section provides that no person shall be granted a commission under the Act unless that person holds: (i) the Diploma in Land Surveying of the University of Mauritius; or (ii) such other qualifications as may be prescribed.

These Regulations prescribe forms of application for obtaining land surveyors' licences and regulate the practice and conduct of licensed land surveyors.The Regulations further regulate the disciplinary proceedings of the Land Surveyors Board and prescribe fees for registration, annual licences, examinations and other purposes under the Licensed Land Surveyors Act.
