Il est créé une agence nationale dont le mandat officiel est de réaliser les opérations techniques devant conduire à l'établissement d'un cadastre pour l'ensemble du territoire national ainsi que de mettre sur pied et de réviser périodiquement un cadastre foncier national. L'agence peut être chargée de procéder à un inventaire systématique de tous les biens immobiliers faisant partie du domaine national. L'agence est dotée de la personnalité civile. Elle est administrée par un conseil d'administration et gérée par un directeur.

The Law is divided into 8 Chapters: General Provisions (I); Ownership and Right to the Use Land (II); General Plans for the Utilization of Land (III); Protection of Cultivated Land (IV); Land for Construction Purposes (V); Supervision and Examination (VI); Legal Responsibilities (VII); Supplementary Provisions (VIII).This Law grants the ownership of land in rural and suburban areas to the collectives. Such land must be registered and recorded by the Governments at the county level. State-owned land may be used by units or by individuals and is recorded by local People's Governments.

The Act (31 sections) is divided into 5 Parts, i.e.: Preliminary (I); Board of Surveyors (II); The Register (II); Registered Surveyors (IV); and Miscellaneous (V).The Board of Surveyors, constituted under this Act, keeps a register of surveyors and deals with offences of and charges against surveyors. The board shall cause a notification of the registration of every surveyor to be published in the Gazette. The Act contains the requirements to be a registered surveyor and describes the powers and duties of surveyors (right to make surveys, entry upon land).

The Act (5 sections, 1 Schedule) sets out the official marks to be used by Government licensed or appointed surveyors in the conduct of official surveys. The use of the marks except in the conduct of an official survey is prohibited and liable to a penalty. Penalties for unauthorized defacement or destruction of survey marks, landmarks or beacons are also provided.

The objective of the Regulations (22 sections, 8 Schedules) is to set out procedures for registration and endorsement of registration of Surveyors (reg. 3). They include detailed rules concerning training and registration of Surveyors - course, training agreement, prescribed qualifications, examinations, cadastral law assignment and registration of Surveyors. The Schedules contain forms for various applications, prescribed qualifications and certificates.

The Act, consisting of 63 sections divided into 6 Parts and completed by one Schedule is composed as follows: Preliminary (I); Administration (II); Licensing and Registration (III); Surveying (IV); Establishment of Land Boundaries (V); and Miscellaneous (VI).

The Act (22 sections) provides for the coordination of surveys and the establishment of a central plan office at the Department of Lands for the recording of surveys, plans and related information. To this end, the Surveyor-General is given powers to ensure coordination of surveys and the Act, and a central plan register is established. Public authorities are to give notice of intention to commence new surveys to the Surveyor-General. The Surveyor-General shall have the power to require connection of proposed surveys to existing surveys, permanent marks etc.

The Regulations contain detailed provisions on the survey register, survey procedures, marks (including sketches), classification and standards of surveys.

The 7 articles regulate the National Land Cadastre. It is maintained and systematic surveys on the status of the land are conducted by the State Institute for Design "Armgiprozem" for the timely exposure, assessment, prevention and abolition of the effects of any negative phenomena (art.2,3). The Ministry of Agriculture is responsible for, inter alia, the registration of land-owners and land-users. The Decree further stipulates duties of land-owners and land-users relating to the timely and up-to-date registration in the Cadastre.

The Regulations provide in detail for Grants, licences and permissions (application, renewal, transfer, reversion) (Part I), Surveys (II), Sale of preferential claims in case of plurality of applications (III), Grants to small cultivators (IV), Leases (for agricultural and grazing purposes) (V), Permissions for grazing areas on the pasture lands of the interior (VI), Licences of Occupancy (VII), Licences to cut wood (VIII), Licences to collect balata, gums etc. (IX), Licences for quarrying stone, gravel, kaolin and other clays (X), Miscellaneous provisions (XI).

The Act declares plans or diagrams based on surveys carried out by means of low altitude photography to the satisfaction of the Commissioner of Lands to have the same effect for all purposes as if it had been prepared under the Land Surveyors Act. (2 sections)
