This Decree defines the procedure and terms for the submission of the application to obtain the environmental integrated authorization required for both new and existing installations covered by Annex I to Legislative Decree No. 59 of 2005, which concerns integrated pollution prevention and control.

This Legislative Decree approves the Code on the Environment, which sets out the legislative framework applicable to all matters concerning environmental protection.The Code is composed of six Parts. This Regulation, made under the Fertilizing Substances Act, makes provision for the implementation of article 5, forth comma of the Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources. The scope of this Decree is to implement provisions of the Act containing rules regarding the emission of ammoniac from animal keeping premises belonging to the livestock sector so as to reduce negative effects caused by emission of ammoniac produced by agricultural enterprises. The Decree prescribes maximum emission values for various types of animal keeping. If animals, for which a maximum emission value is indicated in the Schedule, are kept, no animal keeping system shall be used with an emission factor higher than the value indicated in the Schedule.

The supervision of the Environment, Nature and Town and Country Planning Office and the task of environmental planning is assigned by this Decree to the Minister of Housing, Town and Country and the Environment.

This Act provides for the possibility of exemptions from environmental requirements regarding soil, air and noise prescribed by other legislation in force in the interest of the parsimonious and rational use of living space and optimization of the living environment in urban and rural areas and provides rules relative to procedures of decision making at municipal level and the coordination of decision making.

This Legislative Decree, composed of 50 Chapters, approves the basic Order on Urban and Spatial Planning. In particular, it provides a classification of land comprised under the national territory and defines the basic principles undergoing spatial planning and management. Particular attention is paid to the institution of an integrated management system involving national and local administrations, as well as the provision of framework contracts as urban planning tools.

The present Decree, which repeals Decree of 22 February 2006 on the landfill of waste, establishes the regulatory framework applicable to the installation and functioning of waste landfills. In addition, it sets out measures for the measurements and checks to be carried out by establishments engaged in the landfill of waste with a view to preventing emissions into the atmosphere and waters. Furthermore, the Decree lays down conditions for waste management.

This Act makes provision for the conservation of nature and the protection of the environment in the Cook Islands. It shall apply to such parts of the Cook Islands and Cook Islands waters as are specified from time to time by the Queen's Representative by Order in Executive Council.
