This Sub-Decree determines criteria, procedures, mechanisms and institutional arrangements for initiating and granting new economic land concessions.Economic land concessions may be granted only on land that has been registered and classified as state private land, that has adopted a land use plan, that has completed an environmental and social impact assessment, etc. Economic land concessions shall be granted to achieve the following purposes: develop intensive agricultural and industrial-agricultural activities; increase employment in rural areas within a framework of intensification and diversification of livelihood opportunities and within a framework of natural resource management based on appropriate ecological system; encourage small as well as large investments in economic land concession projects; generate state revenues or the provincial or communal revenues through economic land use fees, taxation and related services charges; etc.The Sub–Decree sets out procedures for initiating, requesting and granting economic land concessions, which may be done through solicited proposals or unsolicited proposals as provided for in the text.The Contracting Authority shall be responsible for ensuring that a Concession Contract is enforced by establishing mechanisms and procedures for monitoring contract performance and for reporting on the management of the contract to the Ministry of Economy and Finance on regular basis and for informing the Technical Secretariat or the Provincial/ Municipal State Land Management Committee.The Sub-Decree further provides for the composition, roles and duties of Contracting Authorities, Technical Secretariat, Provincial/Municipal State Land Management Committees; District Khan State Land Working Group and Commune-Sangkat Councils.
