The objects of this Act, consisting of 99 sections divided into six Chapters and completed by one Schedule, are: a) to provide rules about each neighbour’s responsibility for dividing fences and for trees so that neighbours are generally able to resolve issues about fences or trees without a dispute arising; and b) to facilitate the resolution of any disputes about dividing fences or trees that do arise between neighbours.

South Africa

This By-Law made under the Spatial Planning and Land Use Management Act, 2013, applies to all land within the geographical area of the Ndlambe Municipality, including land owned by the state. The By-law shall, in case of conflict, in principle prevail over other legislation. The By-law requires a municipal spatial development framework to be made and provides with respect its preparation and public participation procedures. The Municipality may also adopt a local spatial development framework for a specific geographical area of a portion of the municipal area.

This Order, made under section 5 of the Town and Country Planning Act, provides for a wide variety of matters regarding the administration and development of the Trelawny Parish Development Area. Matters regulated by this Order include planning permission for development, control on subdivision of land, consultation with national authorities by the local planning authority before granting planning permission, appeals. The Second Schedule sets out Use Classes. The Third Schedule sets out Permitted Development. The Fifth Schedule sets out the Planning Framework for the development area.
