Le présent décret fixe les procédures et conditions d’occupation des terrains à usage industriel, appartenant au domaine de l’Etat et situés à l’intérieur d’une zone économique à vocation industrielle ou situés en dehors du domaine de l’Etat dès lors qu’ils sont destinés à l’exercice d’une activité industrielle ou connexe.

This By-Law made under the Spatial Planning and Land Use Management Act, 2013, applies to all land within the geographical area of the Engcobo Municipality, including land owned by the state. The By-law shall, in case of conflict, in principle prevail over other legislation. The By-law requires a municipal spatial development framework to be made and provides with respect its preparation and public participation procedures. The Municipality may also adopt a local spatial development framework for a specific geographical area of a portion of the municipal area.

The Central Housing and Planning Authority is charged with carrying out of functions under this Act in accordance with section 3. The Authority shall issue rules relative to the preparation and the adoption of town planning schemes, country schemes and supplementary schemes. The Authority may adopt schemes for the whole country, schemes for specified land, schemes proposed by land owners, or schemes proposed by local authorities (sect. 5). These Schemes must be approved by the Governor in Council under section 6. Local authorities affected by a scheme shall be consulted under section 9.

This Regulation amends Paragraph 1 of Article 2 regarding archeological site, Article 6 regarding principles of conservation development plan, Article 7 regarding immovable cultural properties, Article 8 regarding local administration for protected areas, Article 11 regarding modification, revision and annexes of conservation development plan, Paragraph 2 of Article 15 regarding approval of the projects by the Ministry, Article 19 regarding duties, authorities and responsibilities of the experts, and Articles 23 and 25 regarding qualifications of project team members.

This Decree-Law, consisting of 18 articles divided into five Chapters, establishes the general norms regulating the Territorial Land Use Planning (POT) of the Ataúro Island, including its territorial management instruments, as well as actions, programmes, projects and any licensing or authorizations, whether public or private.
