This Law provides for general town and country planning and provides rules relative to development in Jersey. It also provides for the protection of trees. The purpose of the Law is to conserve, protect and improve Jersey’s natural beauty, natural resources and general amenities, its character, and its physical and natural environments. An application for planning permission to carry out prescribed development under this Law shall be taken to include any environmental impact statement relating to the application prepared and provided in accordance with provisions of this Law.

These Regulations prescribe for Wales types of development for the purposes of section 108(2A) and (3C) of the Town and Country Planning Act 1990, which limits the circumstances in which compensation is payable for withdrawal or refusal of a planning permission in accordance with section 108.

Section 3 prohibits transfer inter-vivos of the freehold of any land in Nauru to any person other than a Nauruan person. Such transfer or purported transfer, or any agreement to execute any such transfer, shall be absolutely void and of no effect. Section 4 guarantees validity of existing titles in land, acts relating to land, etc. under the present Act. Sections 5 to 17 concern lease of land for purposes of mining of phosphate and concern certain aspects of use of such land, e.g. removal of sand, removal of trees and vegetation, etc.

This Regulation implements the Vegetation Management Act 1999. It provides for the identification of prescribed regional ecosystems, which are listed in the annexed schedules. It specifies the matters prescribed for property vegetation management plans and sets the value of the development application fee. The Regulation is completed by seven schedules: endangered regional ecosystems, of concern regional ecosystems, least concern regional ecosystems, grassland regional ecosystems, trees precribed for the Act and fees.

This Ministerial Decree establishes the modalities of coordination with Federal Supervision Service over the Application of Legislation on Cultural Heritage of the general land use planning projects of settlements and city districts, projects of planning documentation elaborated for traditional (historic) settlements and land use planning regulations applicable to the objects of cultural heritage. Regulation No. 37 of 1998 provides for the appointment of Land Conveyancer and the establishment of Land Conveyancer Offices. This Letter further defines various matters relating to such officials and their activities. The Conveyancers shall draw up deeds relative to land according to instructions given in comma 4. The provision of this Letter also concerns the fostering and supervision of Land Conveyancers.

This Regional Law delimits plenary powers of the Regional Assembly, Regional Government and regional executive bodies in the sphere of land tenure and land management. It envisages the issues of land governance and, in particular, the modalities of lease of land in accordance with contracts, terms and conditions of allotment of agricultural land to citizens. It also establishes minimum and maximum land areas conceded in ownership to citizens for horticulture, gardening and suburban housing construction, and also concession of public and municipal land to citizens for stockbreeding.
