This Ministerial Decree establishes the structure and rules and regulations as regards land monitoring and the use of data related thereto. Land monitoring shall include survey, mapping and land valuation. Land monitoring shall be subdivided into: (a) monitoring of agricultural land; (b) monitoring of urban land; (c) monitoring of industrial land; (d) monitoring of protected areas; (e) monitoring of forest land; (f) monitoring of land under waterbodies; and (g) monitoring of reserve land.

The present Regulation lays down provisions relating to the subdivision of land. It deals with the following matters: Definitions, applications, maps, additional information, fees, referring application for comment, required rejection, approval of subdivision by plan, referral for comment not required and repeal. The text consists of 6 sections and 3 Schedules.

This Act grants powers to surveyors appointed by the Governor-General for purposes of this Act, imposes certain duties on such surveyors and provides for compensation of damage incurred in relation with surveys carried out under this Act.The surveyors appointed under this Act are granted the power to enter upon any land for the purpose of making any topographical, geological or hydrographical survey and to do all tings as may be necessary for such survey. A surveyor shall give a notice to landowners owners prior to survey.

This Act lays down rules for the licensing of surveyors and the carrying out of land surveys of public and private land and provides for the appointment of a Chief Surveyor and the establishment of the Land Surveyors Board.The Chief Surveyor shall direct and control all public surveys, shall prepare and make public official maps and shall control all plans of surveys before registration of land. The Board shall be responsible for the granting of licences for the practising of land surveying and for the registration of licensed surveyors.

The purpose of this Decree is to prescribe matters necessary for the enforcement of the Cadastral Act.Matters prescribed in this Decree include: criteria requisites for land within a parcel numbering region; classification and determination of land categories; cadastral records; land alteration and cadastral adjustment registration; cadastral surveying; registration of cadastral survey businesses; etc.

This Order establishes terms and conditions for environmental impact assessment (EIA) of the projects related to the use and protection of soil, and quality control of land survey and mapping. The purpose of environmental impact assessment (EIA) shall be to ensure rational and efficient soil management. Environmental impact assessment (EIA) shall be applicable to land survey and mapping practices carried out by entities subordinated to the State Committee on Land Resources, Geodesy and Cartography and by all other entities that have carried out them under licence of the Committee.

The present Regulation introduces some amendments to the Designation of Provincial Forests Regulation 226/88. In particular,it adds clause f to section 15 of the Schedule dealing with survey and mapping of parcels of lands.

Article 21 shall acquire a new wording: “Article 21. Inadmissibility of the use of land plots before delimitation of the boundaries thereof in situ. Landowners shall not be authorized to use land plots allotted by the local self-government out of the stock of public land before delimitation of the boundaries thereof in situ by the State Agency on Land Relations and Cadastre”.

This Regulation shall be compulsory for legal persons, carrying out geodetic, topographic, cartographic, geodetic exploration and cadastre mapping activity. It establishes the modalities of issuing permits for topographic, geodetic and cartographic activity, registration and accounting of the aforesaid activities, storage, retrieval and access to information. Mapping and exploration shall be carried out by legal persons in possession of licence. Mapping of agricultural land, land surveying and forest mapping shall be carried out without authorization.

This Ministerial Decree regards reservation of the plots of land for setting up and expansion of the regional and local protected areas which shall be carried out in accordance with the program of the development of protected areas and ecological networks by decision of the regional and local executive powers. Territorial branches of authorized environmental institution shall draw up proposals and submit application to the local executive powers regarding reservation of the plots of land destined for protected areas.
