The enactments mentioned in Schedule 1 to this Act shall have effect subject to the amendments there specified (being amendments consequential on the re-enactment of provisions in the consolidation Acts). The transitional provisions, transitory provisions and savings contained in Schedule 2 to this Act shall have effect.

These Regulations make provision for the manner in which applications for planning permission, for approvals required by a condition imposed on a grant of planning permission in principle and for certificates of lawful use and development under the Town and Country Planning (Scotland) Act 1997 are to be made.

This Order makes saving, transitional and consequential provisions in relation to the substitution of a new Part 2 to the Town and Country Planning (Scotland) Act 1997 (c. 8) by section 2 of the Planning etc. (Scotland) Act 2006. Part 2 of the Town and Country Planning (Scotland) Act 1997 concerns the adoption of various development plans.

The administration, control, custody and management of the Coastal Zone, and the general administration and implementation of the provisions of this Act are hereby vested in the National Environmental Protection Authority. "Coastal Zone" means the area laying within a limit of twenty five (25) feet landwards of the mean high water line and a limit of two hundred feet seawards of the mean low water line. The Authority shall appoint a Director of Coast Conservation.

The present Regulations are made under the Lands Act. In particular, the Regulations provide for the control of development activities in the St. John’s Urban Region. Section 4 lays down provisions relating to the control of development and establishes that a development shall not be carried out within the development area described in the Schedule except in accordance with the present Regulations. The present Regulations are made under the Urban and Rural Planning Act, 2000. In particular, the Regulations lay down provisions relating to development activities in the Benton Local Area. In this connexion section 3 establishes that a person, corporation, partnership, association or other organization shall not carry out any development in the local planning area unless a permit for the development has first been issued in writing by the authority. The present Regulations are made under the Real Property Tax Act. In particular, the Regulation lays down detailed provisions relating to the enforcement of the afore-mentioned Act in the Province. Section 5 deals with special real property tax levied under clause 12(5) of the Act and establishes that it shall be levied at the same rate as the rate levied pursuant to the Act for the taxation year in which the improvements were made.
