This Order of the Water Resources Management Authority declares the Lake Naivasha Catchment Area to be a protected area for the purposes of the Water Act and provides that the Lake Naivasha Catchment Area Water Allocation Plan shall be the basis for allocation of water in the Lake Naivasha Catchment Area. The Authority shall appoint Water Resources Users’ Associations as agents according to the criteria set out in the Second Schedule. Such Associations shall within their areas of geographical jurisdiction carry out various functions such as: monitor the use of water; facilitate and enforce compliance with the conditions of water use permits; monitor revenue collections and follow up payment on non-revenue generating water used. Every Association shall prepare and submit to the Authority a Soil and Water Conservation Plan, prepared in accordance with the Water Resources Management Rules 2007. The Order furthermore, among other things: provides for data collection and reporting of water abstraction in the protected areas; prohibits cultivation, clearing of indigenous trees or other vegetation, developing or operating greenhouses, disposal of effluent or waste water without treatment or irrigation within Lake Naivasha and the feeder rivers’ riparian land without the prior written approval of the Authority; provides form inspections; and defines offences.
