This Act amends article 164, 165 and 169 of Decree-Law No. 327/90 of 22 October (regulating land occupation after forest fires). Amending articles deal with the requirements to be met by landowners who have suffered forest fires.

This Act provides rules relative to the identification of borders and ownership of land.The sections of this Act are divided into 5 Chapters: General provisions (I); Survey (II); Partition of land (III); Registration and related matters (IV); Miscellaneous provisions, entry into force, and amendment of other Acts (V).The municipalities are vested with the authority to register real property and to decide on matters of partition (sect. 3). Section 4 of Chapter II deals with marking of borders.

These Regulations apply to land to which section 2 of the Physical Planning Act applies. All subdivision of areas to which these Regulations apply shall require the grant of permission of a local authority or liaison committee (reg. 4). Regulations 5 to 12 provides for procedures of applications and registration of applications. The register of applications, containing the information outlined in regulation 8, shall be open for inspection by the general public in accordance with regulation 12.

The Developer shall, before lodging a survey plan for the development area with the Surveyor-General, prepare a lot plan in accordance with this section (sect. 3). A schedule of lot entitlements for the purposes of this Act shall be prepared by a valuer as defined in the Valuation of Land Act (sect. 5). The Registrar-General shall, at the time of creating a folio of the Register under the Real Property Act in respect of a lot, record on the Register and the certificate as to title in relation to the lot (sect. 6).

L'article 1er de cette loi fondamentale sur le remembrement des biens ruraux établit qu'afin d'assurer, dans l'intérêt général, une exploitation plus économique des biens ruraux, il peut être procédé, conformément aux dispositions de la présente loi, au remembrement des terres morcelées et des terres dispersées. Le remembrement tend à améliorer les biens-fonds en constituant, par un nouveau lotissement, des parcelles ayant de plus grandes surfaces, des formes mieux adaptées aux façons culturales et des accès indépendants.
