Esta guía técnica presenta un análisis de las dimensiones jurídicas de las Directrices voluntarias sobre la gobernanza responsable de la tenencia de la tierra, la pesca y los bosques en el contexto de la seguridad alimentaria nacional y su relación con el derecho internacional vinculante.

En la presente guía se aborda el registro de los derechos de tenencia haciendo especial hincapié en mejorar las formas existentes de registrar derechos. Si bien existen numerosos sistemas de registro en todo el mundo que ayudan a lograr la seguridad de la tenencia y brindar otras ventajas a los titulares de derechos de tenencia, también hay muchos sistemas que no funcionan bien y pueden ponerse obstáculos sin quererlo o de forma deliberada para evitar que las personas usen dichos sistemas.

The objective of the Voluntary Guidelines is to provide practical guidance to States in their implementation of the progressive realization of the right to adequate food in the context of national food security, in order to achieve the goals of the World Food Summit Plan of Action. They provide an additional instrument to combat hunger and poverty and to accelerate attainment of the Millennium Development Goals.

This publication is intended to assist anyone involved in the development or implementation of a legal or institutional framework to promote integrated coastal management (ICM). Le cadre juridique est le moyen par lequel s’effectue la transposition des exigences internationales découlant de la Convention-cadre des Nations Unies sur les changements climatiques (CCNUCC) en obligations concrètes et précises pour les pays forestiers, et ce, en fonction de leur situation propre.

Une nouvelle approche reposant sur l'étude juridique et anthropologique des différents systèmes d'exploitation du delta intérieur du Niger (Mali) et de leurs interactions permet de démontrer l'imbrication fondamentale du fonds (défini comme substrat, support des éléments biotiques) et de l'environnement (constitué des ressources renouvelables, en tant qu'enjeu de relations de pouvoirs). Cette démarche interdisciplinaire se fonde sur une approche méthodologique prenant en compte trois échelles d'observation: le terroir villageois, la province et la région.

This publication offers a fresh look at the theory and practice of modern water rights, from a comparative law angle. It sheds light on a number of key features of such rights, and contrasts these to traditional forms and kinds of water rights. It teases out and discusses the relevant problematique, including in particular that elicited the sale and leasing of water rights. The paper examines ways in which the poor can use small amounts of land to establish homegardens to advance important livelihood objectives. The paper considers the potential benefits of homegardens in light of policy, financial and cultural constraints, and provides a framework for planners to consider whether (and which) homegarden interventions are appropriate for improving livelihoods of the poor.
