These Regulations of the Cabinet Secretary implement provisions of the Land Registration Act in respect of the organization and administration of land registries, the procedures for the registration of land, and related matters. The land register referred to under section 7 of the Act shall contain (a) the property section; (b) the proprietorship section; and (c) the encumbrance section. The Regulations set out the content of each section and also of the proprietorship section of a register that pertains to community land.

This Law amends various provisions stipulated by the Law on state survey and real estate cadaster (Official Gazette of the Republic of Montenegro 29/2007).Significant changes are related to the general terms, definitions and denominations; annual plan of works (updated provisions introducing some new provisions); specific rules for geodetic organization related matters; certain financial/fiscal costs/fees as regards the cadaster issues; and offences and consequential penalties.

This Law regulates the issues regarding the state survey, the real estate cadastre and the registration of rights real estate, the cadastre of the water supply pipelines, the basic state map and topographic maps, the boundary of the state border and other specific issues of importance for the state survey and cadaster as official state mapping/survey register.The Law is divided into XIX Chapters and 192 articles, including the offences and related penalties (see Chapter XVIII).

Article 8 shall be amended to add the following wording: “Urban land destined for urban and peri-urban agriculture without constructions thereon and allotted to agricultural organization or peasant farm on condition of permanent (open-ended) land tenure or hereditary life-long possession shall be purchased in ownership by the aforesaid categories of natural and legal persons at the cost of 15 percent of cadastre value of the plot of land at the date of submittal of the application”.

La presente Resolución aprueba el Manual de procedimiento único para la regularización de bienes inmuebles y la adjudicación y titulación de derechos de posesión por parte de la Autoridad Nacional de Administración de Tierras (ANATI). Se aprueba el Formulario único de solicitud de adjudicación de tierras nacionales, el cual constituirá el medio a través del cual la persona natural o jurídica ejercerá el derecho de petición de adjudicación de un terreno nacional.

The document consists of 26 articles. Article 1 determines the purpose of the present Law. Article 2 regards legislation on state land cadastre. Article 4 establishes basic principles of keeping state land cadastre. Article 5 regards state management in the sphere of keeping state land cadastre.
