Decree No. 325 of the Cabinet of Ministers validating the Regulation on compensation of damages caused to forestry due to transformation of deterioration of forestland.

This Decree establishes the modalities of calculation of damages caused to forestry and compensation thereof. It is related to transformation of forestland in case of allotment thereof for purposes not related to forest management and/or deterioration of soil or productivity of forestland. Revenues from compensation shall be accredited to the Agricultural Development Fund and shall be used for financing of forest management.

The present Ordinance implements the Saxony Nature Protection Law of 11 October 1994. Article 1 establishes that the Free State of Saxony grants - under the available budget - financial aid for loss of income caused by significant difficulties to use land. Hardship compensation shall also be granted for damages caused by free living, non-huntable game. The competent authority shall decide upon reasonable discretion taking into account the individual case. The text consists of 4 articles.

Decree No. 94 of the Cabinet of Ministers validating the Regulation on transfer of forest land.

This Decree establishes the modalities of transfer of forest land to other categories of land and the modalities of calculation of e compensation of damages caused to the state as a result of destruction natural forest environment due to transformation of forest land. Destruction of natural forest environment shall be considered any action causing destruction of forest at any stage of its growth.

Item 1 shall be amended to add the following wording: “This Regulation establishes the modalities of calculation of compensation for expropriated land, payment of the aforesaid compensation to the former owners and heirs thereof and the modalities of calculation of payment for transferred urban land”.
