Expropriation Law.

The present Law lays down provisions relating to land expropriation in the Canton of Schwyz. Article 4 establishes that expropriation is, inter alia, admissible for: the rebuilding and enlargement of new streets; the remaking of river banks and brooks; for the building of new churches; the exploitation of material used for building of streets; the erection of new water conducts and fountains.

Article 2 establishes that the competent authorities shall take into account principles of the federal legislation. Ministerial Decree No. 668 on liability for soil damages.

This Ministerial Decree establishes liability and compensation for damages caused to soil by introducing multipliers for different soil types classified as follows: (a) urban land; (b) agricultural land; (c) forested land; and (d) pastures. Polluter pays principle shall be applicable to those find guilty of soil deterioration or soil pollution.

These Regulations prescribe forms, procedures, fees and other matters for the purposes of the Land Acquisition and Compensation Act 1986.The Regulations provide for: acquisition of interests in land; compensation for acquisition and measures of compensation; compensation where no interest in land is acquired; powers of entry and temporary occupation; and determination of disputes.

The purpose of this Act is to ensure the acquisition of immovable properties absolutely necessary for the realization of objectives of public interest determined by the law and, in the same time, to safeguard the balance between public interest and the interests of protection of property rights of owner. Expropriation can be made, exceptionally, by the State or local governments, or a third person if he performs activities determined by Art. 2, and only against immediate, complete and absolute compensation. Administrative and legal proceedings are foreseen in detail by Articles 24-40.

This Act sets out provisions relative to the compulsory acquisition of land for public purposes by the state. The provisions concern, among other things: procedures for acquisition, compensation, registration of lands acquired and regulation-making powers of the Minister.Land shall be declared to be land required for public purposes by an Order of the President. Parliament may approve such Order. The Act defines the functions of the Commissioner of Lands and the Registrar General in the process of acquisition. The Act also concerns (deemed) abandonment of acquisition.

Measures for Announcement of Land Expropriation.

These Measures regulate the announcement of land expropriation, protect the legitimate rights and interests of rural collective economic organizations, rural villagers or other right holders, and guarantee the land for economic construction.The Measures provide for contents of announcements of land expropriation and of plans on compensation for land expropriation and relocation and for disputes.

This Act amends the State Lands Act, originally titled “Crown Lands Act”, in section 6 by adding a subsection to a provision that gives powers to the Minister to exchange portions of State land for portions of private freehold land. The new section empowers the Minister to require, in addition of exchange, payment as a contribution for the value of the State land subject of exchange.

Enclosure Act 1782.

This Act provides rules for the resolution of disputes regarding enclosure of land. It also provides for remedy in case neglect, refusal, or delay of the owner or owners, proprietor or proprietors, of any land or ground so adjoining the tract or parcel of land or ground about to be enclosed, to contribute to costs and repair of post and rail enclosures at joint expense.

Soil Protection Implementation Law.

The purpose of the present Law is to implement the Directive 2001/42/EC of 27 June 2001of the European Parliament and of the Council on the assessment of the effects of certain plans and programmes on the environment. In particular, the Law enacts the Federal Soil Protection Act of 7 March 1998 (BGBl. I p. 502). Article 1 establishes that land in general shall be used sparingly, and in particular sealing of the soil surface shall be limited to a minimum.
