These Rules are made under section 181 of the principal Act, and relate to the procedures to be followed in the application to the Registrar of Titles, under section 133 of the Act, for confirmation of possessory title. The model form is presented in the annexed Schedule.

These Regulations (24 sections and 1 Schedule) are made pursuant to section 181 of the principal Act and relate to the faculty of any person who considers himself entitled to absolute ownership of any land, either in his own right or as trustee, and who is or would, but for some tenancies or incumbrances, be in actual possession of the land, to apply for a certificate of possessory title. They specify the contents of the request, notice requirements, legal/administrative proceedings, etc. The Schedule contains model forms for the purposes of these Regulations.

This Act provides rules relative to the identification of borders and ownership of land.The sections of this Act are divided into 5 Chapters: General provisions (I); Survey (II); Partition of land (III); Registration and related matters (IV); Miscellaneous provisions, entry into force, and amendment of other Acts (V).The municipalities are vested with the authority to register real property and to decide on matters of partition (sect. 3). Section 4 of Chapter II deals with marking of borders.

Transfer of real estate within the boundaries of the Master Plan for Baghdad or the boundaries of the main master plans of Aqdiyas and Nahiyas attached to the Baghdad Governate of a certain type shall not be registered unless the person to whom the property is transferred was recorded in the 1957 census or any previous census in one of the regions mentioned or regions attached to the Baghdad Governate before the creation of the Sallah Al-din Governate. This rule shall not apply to transfer of property because of death. (3 sections)

The scope of the present Decree of the Ministry of Agriculture is to provide a clear picture of all land suitable for cultivation but presently not in use. Such land shall be under consideration for measures to be taken pursuant to section 8 of the Land Use Act of 1995. Municipalities shall be responsible for registration. Priority shall be given to land in good shape in areas where a lot of cultivation takes place. Position, present condition, and size shall be registered and information provided on the best possible use, suitability of the land, etc. (4 sections)
