Town and Country Planning Act 1951 (Cap. 246).

This Act makes provision with respect to development and spatial planning in Uganda. It establishes the Town and Country Planning Board. The Act shall apply to declared planning areas. In respect of every area declared to be a planning area, there shall be a planning committee or planning committees. The Board shall in respect of any area declared as a planning area, in consultation with the committee or committees, prepare an outline scheme in respect of the area. This scheme must be approved by the Minister.

The purpose of this Act is to promote planned and systematic urban development, create a comfortable urban environment and promote public welfare by prescribing matters necessary for urban development. For the purpose of the present Act «urban development project» means a project implemented to build a complex or town having functions, such as residence, commerce, industries, distribution, information and communications, ecology, culture, health and welfare in an urban development zone.

This Act, consisting of 54 sections divided into six Parts and completed by one Schedule, aims at finding a compromise between the cultural traditions of the Aboriginal and the need for development of the Northern Territory. The Act establishes the procedure for the registration and protection of sacred sites and prescribes how to protect sacred sites in the planning for the development and use of land. For the purposes of the Act, Aboriginal Areas Protection Authority is established and regulated.

This Decree sets forth provisions on efficient use of land for all land owners, users and lessees, soil operations, protection of environment, soil protection, improvement of natural and man-made landscapes, scientific research and sustainable development. The Act makes provision with respect to titles in land, the development of selected land, and the resolution of disputes regarding land and various other matters relating to land. As a corollary to the principle that land in Lesotho is vested absolutely and irrevocably in the Basotho Nation and is held by the State, no person, other than the State, shall hold any title to land except as provided for under customary law or under this Act. Where the customary law is inconsistent with this Act, this Act shall prevail (sect. 3).
