This Decree prescribes the procedures for exchange, transfer, lease, sublease and inheritance of land-use rights as well as mortgages and as capital contributions in the form of land-use rights. Article 3 specifies documents required for the exercise of a land-use right. Article 5 defines the conditions on which exchange of the right to use agricultural, forestry and residential land may take place, whereas article 8 specifies conditions for the transfer of the right to use agriculture and forestry land by households and individuals; article 12 lays down conditions for transfer by organizations. Article 32 lists conditions that have to be met by households and individuals for contribution of land-user rights to business cooperation forms; article 35 does the same for organizations.
