Proclamation No. 0067.PROR.KOR.KOR.SOR.KOR. on setting up a limit of the forest belonging to the inland and marine fishery domain.

This text consists of 6 articles. Article 1 establishes the concept of precinct forests defined as the inland and marine fisheries domain and reserved for fishery productivity. Article 2 subjects the issuing of the land property in the precinct forest to the approval by the Ministry of Agriculture. The conduct of activities such as clearing, chopping, reclaiming or burning is prohibited unless prior authorization of the Ministry of Agriculture has been granted (art. 3).

La presente Ley, que consta de 19 artículos, tiene por finalidad promover la conservación, mejora y restauración de los suelos y las aguas, que son parte de los recursos naturales renovables del país (art. 1º). El Ministerio de Agricultura e Industrias será el organismos encargado de poner en práctica esta Ley (art. 3º); clasificará las diversas clases de suelos por su valor agronómico, estableciendo las zonas aptas para su explotación agrícola, ganadera y forestal (art. 4º).

The Act provides for the designation of land use of the Cook Islands. The 17 sections are divided into 3 Parts: Zoning Orders (I); Land Use Board (II); Administration (III). The High Commissioner may issue Orders to establish zones of land use. The use of land within the created zone shall be pursuant to the Order (sects. 3 and 4). Except in accordance with the terms of the Order, an occupier shall not make any permanent improvement or alteration or erect any building without the prior consent of the Board (sect. 6).

La habilitación y rehabilitación de las tierras erosionadas y su posterior conservación, así como la protección de las tierras colindantes del peligro de la erosión, es una obligación imperativa de los habitantes del Departamento de Tarija. En particular los propietarios de tierras erosionadas o en peligro de erosión están obligados a ejecutar las obras necesarias para su rehabilitación y protección con sujeción a lo dispuesto por el Gobierno en el marco del Programa Ejecutivo de Rehabilitación de Tierras en el Departamento de Tarija.

Act No. XCIII of 1995 on the restoration of protection levels in protected areas.

The aim of this Act is to re-establish protected areas on land previously owned by agricultural cooperatives before privatization. This goal is achieved through: expropriation, if the area has already been assigned to a private owner; or by not assigning such lands to private owners. Paragraphs 2-4 deal with cases in which expropriation is not obligatory and with cases in which compensation should be paid to the owner. Expropriation should be carried out, at the latest, within 3 years from the entry into force of this Act.

This Law concerns the formation, organization, preservation and use of nature reserves. There are four types of reserves: (i) state conservancies, where most human interference is prohibited; (ii) national parks, where activities are somewhat less restricted and which are intended for recreational, historical, cultural and scientific purposes; (iii) state reserves, the characteristics of which are not specified; and (iv) natural monuments, which are natural objects of special scientific and historical cultural value.

The District Council may declare any area a prohibited or preserved (area). All areas listed in the First Schedule are hereby declared preserved areas (by-law 3). No person shall cultivate, cut any grass, or graze animals in any preserved area (by-law 4). The Council shall, after consultation with the Agricultural Officer, prescribe the type of agricultural or animal husbandry, the type of crops that may be planted and the steps taken to prevent soil erosion and to conserve water in a prescribed area (by-law 5).
