This Law amends Law No. 5403 on Soil Preservation and Land Utilization with several minor changes. This Law adds Articles 8A to 8K regarding agricultural land sizes and transfer of inherited agricultural lands. This Law repeals the last sentence of Paragraph 5 of Article 13 of Law No. 3083 on land reform regarding rearrangement of land in irrigated areas.

Administration of Estate (Small Estate Payments Exemption) Law, 2011.

This Law provides with respect to inheritance and transfer of small estates (as defined). and provides that the Administration of Estate Law, Probate rules, or any other law or rules of court under which grant of Letters of Administration is required for payment of money from the estate of deceased persons shall cease to apply to small estates except as provided in this Law.

This Law stipulates that notwithstanding any native law or custom to the contrary a female person has the right to acquire and own property and shall share in the intestate estate of her deceased father, mother or husband in accordance with the provisions of this Law. Females may be the administrator or one of the administrators of her fathers, mothers or husbands estate. The Law also grants other rights to women and provides protection of women from degrading treatment and provides with respect to alienation of property. or interest in the matrimonial home.

The Nyanga and Matopos Estates shall vest in the President and, subject to this Act, shall be held in trust by him for the people of Zimbabwe. The Trustee may, subject to section 5 and of sections 4 and 6, in addition to using the Estates in the manner set out in the Will of Cecil John Rhodes, use portions of the Estates for agricultural purposes, including forestry, fisheries and the conservation or management of wild life and other purposes set out in section 5. The Trustee may grant such servitudes in respect of any portion of the Estates pursuant to section 7.

This Act concerns the abolition on certain restrictions concerning trusts and provides rules for the creation in Nauru of a trust in perpetuity or for any lesser duration. This Act shall not apply to any settlement, disposition or trust of any land or of any interest in any land where such land is situated in Nauru. The Act also concerns grant of administration of a foreign will or estate. Executors of a foreign will or administrators of a foreign estate shall be a trustee corporation.

The President decrees that the plots of land and the property connected with them must be considered real estate. The real estate contracts are regulated by Civil Code in accordance with Land, Forestry, Environmental, other specific Legislative Acts and this Decree. Physical And juridical persons, that own plots of land, have the right to sell, to bequeath, to give as a gift, to mortgage, to lease, to exchange and to render them as a share to the-joint stock companies. Each landowner is provided with land certificate that must be registered into land cadastre.
