The present Act lays down provisions relating to agricultural lands in the domain of the state. It applies to any agricultural land in the domain of the State, hereinafter referred to as “ungranted land”. It applies also to any agricultural land in the domain of the State considered as “land under concession”. No person may cut timber on ungranted land or on land under concession unless he is authorized to do so by the Minister, subject to paragraph 3 of Section 47, or if he fails to meet the conditions and to pay the duties prescribed by regulation.

The present Act lays down provisions relating to coal. For the purpose of this Act "coal land" means land in which the coal or the right to explore for, develop and produce coal is vested in or reserved to the government. The Act contains at the outset a definition clause relating to various terms therein employed such as, “coal land reserve”, “lease”, “licence”, “location”, “owner”, “protected heritage property”, “recorded holder”, “surface area”.

This Act applies to: 1) formation of real estate and other register units; 2) changing the property division in other ways; 3) confirmation of matters concerning the dimensions of a register unit or other property division matters; and 4) registration and amalgamation of real estate and other register units. The present Act does not apply to a matter concerning the formation of real estate provisions for which is made in other legislation (sect. 1).

Law No. 16/92 on the activities of sworn surveyors.

This Act authorizes sworn surveyors to carry out activities as independent professionals and private entities are authorised to carry out topography, photogrammetry and cartography. The Council of Ministers shall have authority to issue Regulations governing those activities. Decree Law 29/75 of 23 October prohibited private surveyors from carrying out those activities as independent professionals and prohibited private companies.

Article 1 of the principal Regulations is amended. Section 1 concerns the qualifications of sworn surveyors. A new comma is added. This provision blocks a State employee employed in the National Directorate of Geography and Cadastre or Provincial Services thereof, or working under contract on or off the staff, or on any projects realised within the framework of the aforesaid institution from exercising the activity of a sworn surveyor.

The Act on activities of sworn surveyors establishes the right of surveyors to carry out activities as independent professionals and private entities such as of topographic, photogrammetric and cartographic work. These Regulations regulate such activities. Regulations concern qualifications, authorization, definition of actual work, registration, contracts for the provision of services, etc. The licence of a sworn surveyor is issued by the Minister of Agriculture.

The following amendments and addenda must be introduced to the Federal Law No. 209-FZ: 1) In the item 2 of the Article 3 must be supplemented with the wording “topographic monitoring”; paragraph 11 of the same article must be supplemented with the wording “provision with geodetic, cartographic, topographic and hydrographical materials regarding regional and state boundaries”; paragraph 15 of the same article acquires a new wording “setting, normalization, regulation of usage, registration, recording and conservation of the names of geographic objects’’.

The present Law determines the legal basis for carrying out geodetic and cartographic activity and is aimed at meeting the demand of legal and physical persons in geodetic and cartographic products. This Chapter provides for the management and other matters of Government land. It consists of 8 Articles divided into sections. Article 1 contains general provisions. The Department of Land Management shall have authority of all government real property for purposes of this Chapter. The Director of Land Management may, when necessary, reserve or set aside government real property not reserved by law for specific public use for the future use of any other department or agency of the government pursuant to section 5.

The purpose of the present Law is to establish the legal basis for keeping state land cadastre, use of cadastre data for economic development, ensuring the right to the plots of land, rational use, rehabilitation and protection of land. State land cadastre is a basic component of the Common system of state cadastres and represents the system of data and documentation regarding natural, economic, legal characteristics of land, categories, qualitative aspect and value, location and size of the plots of land, distribution among the owners, leaseholders and landlords thereof.

The present Law establishes the legal basis for geodetic and cartographic activity. The objects of geodetic and cartographic activity are the national territory and outer space (art. 3). Geodetic and cartographic activity of governmental importance shall include: 1) creation, renewal and publication of topographic maps and plans; 2) distant zoning of the Earth; 3) demarcation and inspection of state boundaries (art. 6). Geodetic and cartographic activity shall be subject to licensing in conformity with the modalities established by Law (art. 13). The Law consists of 16 Articles.
