The provisions of this Ministerial Decree shall be applicable to agricultural land. This Ministerial Decree establishes the modalities of settling land disputes originating from the request of local rural administrative body submitted together with agricultural enterprises and other organizations concerned to the local self-government managing the disputed land areas to restitute them. In the request complainant, respondent party, circumstances substantiating the complaint, claims, land area and location thereof. The respondent party shall examine claims and shall give motivated written answer within 15 days from the date of reception of complaint. In case of refusal to restitute the disputed land area it shall be backed by documentation asserting the right to the disputed land area. In case of transfer of land in accordance with the restitution contract all the constructions and perennial vegetation shall be also subject to transfer. All the disputes regarding land boundaries shall be settled in accordance with legislation taking as a basis the year of registration of agricultural enterprise.
