These Regulations provide for the payment of aid to farmers who undertake to introduce organic farming methods and comply with certain environmental management conditions, pursuant to Article 2(1)(a) and (d) of Council Regulation (EC) No. 2078/92 and implement Commission Regulation (EC) No. 746/96 laying down detailed rules for the application of the Agri-environment Regulation. The Order applies to all animal fertilizers (manure). Its purpose is to set regulations on standards for the establishment of animal keeping compounds and the storage of such biomass. In Chapter 2 it sets regulations on the establishment of facilities, as well as extensions and modifications thereof for animal husbandry; these shall not be permitted if causing pollution. Stables and similar enclosures for animals shall be designed so that contamination of groundwater and surface water does not occur. They must have floors constructed of durable materials which are impermeable to moisture.

These Regulations provide rules relative to good agricultural practice to protect waters against pollution from agricultural sources and prescribe measures for these purposes, including: periods when land application of fertilizers is prohibited; limits on the land application of fertilizers; storage requirements for livestock manure; and monitoring of the effectiveness of the measures in terms of agricultural practice and impact on water quality. They also concern minimization and storage of soiled water and ploughing and the use of non-selective herbicides.

These Regulations amend the Common Agricultural Policy Single Payment and Support Schemes (Cross-compliance) (England) Regulations 2005 in paragraph 3 of the Schedule so as to allow the Secretary of State, in exceptional weather conditions, to exempt farmers from requirements relating to waterlogged soil for a reasonable time.

These Regulations establish and introduce an action programme for the protection of waters against pollution caused by nitrates from agricultural sources that is applicable to all farmers across Northern Ireland.

By virtue of this Decision, England, Scotland and Wales are granted a derogation for the purpose of allowing a higher amount of livestock manure than that provided for in the first sentence of the second subparagraph of paragraph 2 of Annex III to Directive 91/676/EEC, subject to the conditions prescribed by these provisions.

The provisions in this Order apply to the specific financial support granted to farmers. Extensive farming in eligible areas where single payment scheme for the limited use of nitrogen and without the use of plant protection procedures applies, may be used for organic agricultural production.

The present Regulations are made under the Real Property Assessment Act. In particular, the Regulation lays down detailed provisions relating to the enforcement of the afore-mentioned Act in the Province. For the purpose of the present Regulation, “assessment list” means a list of all properties in a municipality and such assessment list shall contain all of the information described in clause b) in relation to those properties and the number of the municipality.
