Regional Law No. 172-ZO “On conservation of agricultural soil fertility through biologization”.

The scope of this Regional Law shall be to ensure reproduction of agricultural land fertility through biologization of arable farming by land owners, land tenants, including lease holders. Owners, tenants and lease holders of agricultural land shall have the following rights: (a) carry out phytoagrotechnical, phytosanitary, land reclamation and anti-erosion arrangements; and (b) have access to information related to soil fertility managed by state bodies.

This Regional Law establishes maximum land area of land parcels allotted in ownership to citizens free of charge as follows: (a) for peasant farms – 8 ha; (b) for gardening – 0,10 ha; (c) for horticulture – 0,10 ha; for suburban housing construction – 0,04 ha; (d) for subsistence farming – 0,15 ha; and (e) for individual housing construction – 0,15 ha.

These Regulations provide compliance with the Environmental Impact Assessment (EIA) Directive 85/337/EEC as amended insofar as it applies to certain categories of on-farm activities. They make provision for a statutory screening and consent system for these activities and also for environmental impact assessment for such development if it is likely to have a significant effect on the environment.

These Regulations amend the Action Programme for Nitrate Vulnerable Zones (Scotland) Regulations 2008 to, among other things: implement, as regards Scotland, of Article 5 of Council Directive 1991/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources, which requires Member States to establish, review and, if necessary, revise action programmes for designated nitrate vulnerable zones; revise the action programme established by the 2008 Regulations for the nitrate vulnerable zones in Scotland designated by regulation 3 of the Designation of

Regional Law No. 76-ZKO “On maximum areas of agricultural land allotted for agricultural purposes”.

This Regional Law establishes maximum land areas that can be allotted in ownership to citizens out of stock of public land for farming, gardening, horticulture, stockbreeding and suburban housing construction. Allocation of the aforesaid land parcels to citizens shall be performed by state executive body or local government. Maximum land areas shall be set forth as follows: (a) for farming – up to 150 ha of agricultural land; (b) for gardening and horticulture - up to 0,4 ha; (c) for stockbreeding – up to 10 ha; and (d) for suburban housing construction – up to 0,5 ha.

The purpose of this Regulation is to increase the quality of previously drained agricultural land by providing subsidies for drainage of poorly drained soils, with potential for the increase of agricultural production and to minimize erosion and runoff of nutrients into watercourses. Subsidies for drainage of agricultural land shall correspond to NOK 1 000 per hectare.

This Regional Law establishes minimum and maximum land areas of public and municipal land to be allotted to regional residents in ownership for farming, gardening, horticulture, stockbreeding and suburban housing construction. It shall not be applicable to agricultural land and it shall not be applicable to purchase of land in ownership by citizens.

This Regional Law establishes maximum total land area that can be owned or belong in any other form to citizens carrying out subsistence farming. Maximum land area of agricultural land cannot exceed 2 ha per each subsistence farm. In case of excess of the aforesaid limit the exceeding land area must be expropriated within one year from the date of origin of the aforesaid rights or within the same time period the citizen must be registered as individual entrepreneur in the form of peasant farm.

This Regional Law establishes minimum and maximum land areas out of stock of public and municipal land allotted to citizens in ownership. Land parcels shall be allotted to citizens for peasant farming, subsistence farming. individual housing construction, gardening, horticulture and stockbreeding. Decision on allotment of land parcels shall be made by the Regional Administration and local government within their competence. Maximum land areas of land plots allotted to citizens free of charge shall be established in accordance with legislative acts validated by the local government.
