This Act aims at transferring to and vesting in the Government the ownership and possession of all ecologically fragile lands held by any person in order to minimize the degradation of these ecosystems and their biological diversity.The Government shall have the right to declare any land to be ecologically fragile land which shall be deemed to be reserved forests according to the provisions of this Act.The Act provides for the constitution and functions of an Advisory Committee which shall be responsible for identifying ecologically fragile lands which shall then be managed by Forest Depart

The following wording shall be added to article 61(2): “Damages caused to citizens or legal persons as a result of the validation by a state executive body or local self-government body of a legislative act that does not comply with the law or other legislative acts and that infringes on the land rights of citizens shall be subject to compensation in accordance with civil legislation.”

The purpose of this Law establishes criteria for calculating damages for the cultivation of land allocated for non-agricultural purposes. In the event agricultural land is allocated for non-agricultural purposes, substitute land cultivation costs shall be reimbursed and appropriate damages caused by the deprivation or temporary tenure of land shall be paid. The procedures and conditions Law shall apply to agricultural lands, land fit for agricultural purposes and land located beyond built-up areas that cannot be used as agricultural land in the future.

The present Act lays down provisions relating to the acquisition of surface rights to land and the determination and payment of compensation. In particular, the purposes of the Act are: a) to provide for a comprehensive procedure for acquiring surface rights; b) to provide for the payment of just and equitable compensation for the acquisition of surface rights; c) to provide for the maintenance and reclamation of the surface of land acquired in connection with surface rights acquired under this Act.

This Act defines the liability of an occupier of premises for injury to persons or damage caused to goods and resulting from actions or omissions of the occupier in respect of the occupied property. The Act also defines the liability of a landlord under the obligation of maintenance or repair of the occupied property.

Methodical Instruction on the partition of agricultural land into shares.

This Methodical Instruction provides for the partition of agricultural land into shares to divide common property ownership. Each holder of common property shall have the right to separate out its share, establish the location of its land plot and determine the amount of compensation to the common property holders. Partition of irrigated agricultural land pertaining to common property shall be prohibited if the separated land area is less than the minimum size for reclaimed land established by the regional authority.
