This Act extensively amends the principal Act. It is composed of 13 Parts, divided into 79 sections, entitled as follows: Interpretation and application (I); Purpose and principles (II); Duties and restrictions under this Act (III); Functions, powers and duties of central and local government (IV); Standards, policy statements and plans (V); Resource consents (VI); Coastal tendering (VII); Designations and heritage orders (VIII); Subdivisions and reclamations (IX); Declarations, enforcement and ancillary powers (X); Miscellaneous provisions (XI); Transitional provisions (XII); Other provisions (XIII).Principal amendments: Section 15B, as inserted by the Resource Management Act (No. 105 of 1994) is replaced with new provisions which elaborate and somewhat relax the prohibition to discharge harmful substances or contaminants in the coastal marine area, taking into account the existence of regulations on these matters. Such activity is not allowed unless (a) permitted under regulations, coastal plans, regional plans, resource consents, etc.; (b) after reasonable mixing, the discharge is not likely to produce certain deleterious effects such as production of foams, odours, etc.; (c) the discharge into air is not likely to be noxious, dangerous, offensive etc. Similar provisions apply to the discharge of water into water in the coastal marine area. Section 108 of the principal Act on Conditions of resource consents is amended by enlarging the list of such conditions. The first schedule of the principal Act on Preparation, change and review of policy statements and plans is repealed and substituted with an updated version of the Analysis.
