"Labour tenant" is defined in section 1 as a person who: (a) is residing or has the right to reside on a farm; (b) who has or has had the right to use cropping or grazing land on the farm, referred to in paragraph (a), or another farm of the owner, and in consideration of such right provides or has provided labour to the owner or the lessee; (c) whose parent or grandparent resided or resides on a farm and had the use of cropping or grazing land on such farm or another farm of the owner, and in consideration of such right provides labour to the owner or the lessee of such or such other farm, including a person who has been appointed successor to a labour tenant in accordance with the provisions of section 3(4) and (5), but excluding a farmworker. Provisions of Chapter II confirm the right of labour tenants to occupy and use land which was either held by him or her on 2 June 1995 or the occupation and use of which is restored to him or her in terms of this Act or any other law (sect. 3). Other provisions of this Chapter concern eviction of labour tenants and other persons and reinstatement or labour tenants by Court Order. Chapter III provides for the acquisition of ownership or other rights in land by a labour tenant and related procedures of arbitration or court proceedings. Chapter contains provisions concerning the Land Claims Court and Arbitrators; Chapter V contains miscellaneous provisions.
