La présente loi met en exécution la loi fédérale du 4 octobre 1991 sur le droit foncier rural. L’article 7 établit que tout morcellement d'immeubles situés en zone agricole qui a pour effet de créer des parcelles d'une superficie inférieure à 25 ares est interdit. Cette surface est réduite à 15 ares pour les parcelles incorporées dans le cadastre viticole.(1) Des autorisations exceptionnelles peuvent toutefois être accordées par l'autorité compétente pour justes motifs, au sens des articles 59 et 60 de la loi fédérale, et si aucun intérêt prépondérant de l'agriculture n'est lésé.

This Act of New Zealand, consisting of 24 Parts and three Schedules, provides for matters of government of the Cook Islands, for various matters of general law of the Cook Islands and for the administration of various matters relating to public and private land.The Act provides for the institution of Island Councils and the High Court of the Cook Islands. It defines criminal offences and prescribes criminal procedures.

The present Ordinance lays down provisions relating to the granting of financial contributions for the conservation of natural flora in the Canton of Appenzell Inner-Rhoden and establishes measures relating to biological qualities of plots of land. The Agriculture and Forestry Office is charged with the implementation of the present Ordinance. The text consists of 11 articles divided into 4 Parts as follows: General provisions (I); Biological quality and harmonization of ecological measures pertaining to plots of land (II); Subsidies (III); Final provisions (IV).

The present Law supplements Law No. 7745 on the re-evaluation and re-distribution of the ex-agricultural cooperative property by introducing new provisions dealing with the social and cultural assets of the ex-agricultural cooperatives and the offices of the ex-people’s councils. They can be transferred to the commune or the municipality upon decision of the competent council. The compensation shall be paid within three years.

This Decision sets out methods for evaluating the ex-agricultural cooperatives property. Whenever the property is evaluated and distributed, or has not been distributed, the prices to be applied will be those of the evaluation period indexed at the re-evaluation time, while in cases where the property is evaluated and compensation has already been paid, the case is considered completed and no indexes shall be applied.

This Decree contains rules relative to various stages of and the procedures for the partition of land in accordance with the Land Partition Act. It also defines the duties of local authorities in this process. The stages are, among other things, survey and mapping, the establishment of borders of land, distribution of registration numbers and assignment of an official address.

This Law defines the legal regime of refused agricultural lands (lands which are not accepted into use or ownership by farmers). Refused lands are considered as State agricultural lands. They are transferred to the administration of the General Directorate of Forests and Pastures. The latter, through its regional directorates and in collaboration with the land distribution commissions, determines the areas of refused lands based on the data given by the municipalities and communes and certified by the immovable property offices.

Non-divided lands administered by the General Directorate of Forests and Pastures and distributed according to Law No. 8047 of 1995 on the administration of refused lands shall be transferred to the administration of the communes or municipalities councils. The Regulation sets forth priority criteria for distributing land.

This Regulation lays down amendments and addenda to Regulation No. 531 of 1998 on non-divided agricultural lands. According to these new provisions, undivided agricultural lands, as identified by the competent municipal commission and certified by the chief of the immovable property registration office, can be rented by the local government to foreign and domestic individuals or legal entities.

This Act lays down guidelines for the creation of strata titles and it shall apply only to registered land. Every original proprietor of land may subdivide that land into stratum estates upon certification of a strata plan by the Commissioner. Requirements for strata plans, units and common property are provided for in the Act. On the certification of a strata plan by the Commissioner, the original proprietor of the lot to which the plan relates shall become a strata corporation.

The present Regulation introduces some amendments to the Designation of Provincial Forests Regulation 226/88. In particular, it amends section 3 concerning plans of subdivision.
