The research provides a holistic overview of the key changes that affected Northern Chin society from pre-colonial times up to now in villages close to Hakha town where State penetration was stronger than in more remote
areas. The study sheds light on the overlapping and evolving statutory and customary land systems and on the issues faced by contemporary Chin communities as they seek to govern land and natural resources.

Dans un contexte de pression accrue sur les terres et les ressources naturelles, la formalisation (reconnaissance légale et écrite) des droits fonciers est aujourd’hui présentée comme un moyen à privilégier pour une meilleure sécurisation foncière.

Following the success of the inaugural Regional Land Forum in Hanoi in 2016, the Second Regional Land Forum was held from 28-30^th May, 2018, in Bangkok. The Regional Land Forum aims to provide a multi-stakeholder platform for networking and dialogue on land governance issues across the Mekong region, particularly Cambodia, Laos, Myanmar and Vietnam (CLMV).

Agroecology being diverse and multidimensional, a broad range of issues were addressed such as the fundamental role of crop biodiversity, the highly preoccupying status of agrochemical use in the region, the need for appropriate-scale machinery, the importance of innovative and  participatory intervention mechanisms, the recognition and integration of Indigenous Knowledge, the capacity building of the new generation, the marketing of agroecological products…

Three main take home messages emerged from all the discussions:

Les investissements privés dans les terres s’accélèrent avec des interrogations sur leurs impacts économiques et fonciers pour les populations. Les appels pour améliorer la gouvernance foncière se multiplient. De nombreuses institutions internationales et agences de développement appuient la mise en œuvre de politiques et de programmes de formalisation des droits fonciers, censés apporter des réponses aux défis du développement.  Mais que signifie la formalisation des droits fonciers dans des contextes de pluralité des normes ? Quelle est la gamme des options ?

The « Environment and Natural Resources Code of Cambodia » (Sixth Draft – – 20 November 2016) is a very extensive proposed law (535 pages !) which will have, if adopted, major impacts on many aspects of Cambodian development (Mines, Energy, Urban planning, etc..) but is particularly important for the management of Protected Areas and of Forests and Fisheries. The code has been elaborated by a panel of experts and several working groups led by Vishnu Law Group. A public national consultation has been organized by MOE in Dec 2016.

Cette étude sur les transactions foncières dans les campagnes cambodgiennes part d’un double constat. D’une part, la politique foncière cambodgienne, essentiellement structurée par un grand programme de cadastrage et d’immatriculation foncière (LMAP) financé par la Banque mondiale, ignore les relations foncières ne correspondant pas au modèle de la propriété privée individuelle, à savoir les droits délégués et les modes de faire-valoir indirect.

Au Burkina Faso, le gouvernement a entrepris l’élaboration d’une politique nationale de sécurisation foncière. Le processus d’élaboration devait être « participatif » et assurer un large débat au sein des différents groupes d’acteurs concernés. Prévu pour durer 8 mois, il s’est étalé de décembre 2004 à octobre 2007, soit près de trois ans.

Dans le cadre d’un chantier de réflexion initié par le Comité technique « Foncier & développement » sur l’évolution des structures agraires et l’accès des jeunes à la terre, la présente séance a visé à apporter des éclairages sur les conditions d’accès (ou d’exclusion) des jeunes au foncier dans un contexte d’économie de marché.

This paper aims to provide keys that will help us understand contemporary land dynamics in these four countries. In order to do so it highlights their similarities and differences, both in the long history that shaped today’s local land situations and in more recent reforms implemented in the context of greater economic openness.
The first part of the paper sets the cultural and historical context, with an overview of the diverse ways that the political authorities and different groups within the region have related to land.
