L’article 1er établit que la présente loi s’applique à toutes les activités ayant des effets sur l’organisation du territoire qui sont soumises à planification, qui sont soumises ou non à l’octroi d’un permis de construire, et qui ne sont pas réglées de manière exhaustive par d’autres législations. The Law 10360 of 2010 amends Article 92 of Law 10119 of 2009 by extending several time periods prescribed for starting with the full implementation of the Law from ‘no later than 15 January 2011’ to ‘no later than 30 September 2011’.

The present Ordinance implements the Federal Land use Planning Act of 22 June 1976 and the Building Law of 3 December 1978. In particular, the Ordinance lays down provisions relating to the cantonal land use plan. The purpose of the plan is to coordinate the land use planning of the federal state and the other cantons. These Regulations amend the Planning and Development Regulations 2001 in articles 186 and 191 in relation with an application for a licence for an outdoor event.

The present Law lays down provisions relating to land use planning in Bavaria. In particular, the aim of the Law is to develop and secure the whole territory of Bavaria with a view to town and country planning thus creating and conserving healthy living and working conditions. The text consists of 34 articles divided into 7 Parts as follows: General provisions (I); Organization of land use planning (II); Land use plans (III); Safety clauses of land use planning (IV);Basis for data collection and monitoring (V); Other proceedings (VI);Final provisions (VII).

The present Law implements the Federal Land Use Planning Act (BGBl. I p. 2081, p. 2102) and the Land Use Planning Law of 28 April 1998 of Sachsen-Anhalt. The Law lays down provisions relating to the regional development plan of Sachsen-Anhalt. In particular, the purpose of the Law is to maintain the perfect functioning of the ecosystem in the populated and unpopulated area of the Land. In all parts of Sachsen-Anhalt balanced economic, infrastructural, social, environmental and cultural conditions shall be ensured. The text consists of 7 Parts.

Article 5 shall be amended to add the following wording: “Article 5. Competent federal executive bodies in the sphere of denomination of geographical objects shall carry out denomination of geographical objects in accordance with other federal executive bodies within the sphere of competence thereof in accordance with the modalities envisaged by the legislation of the Russian Federation”.

The Government establishes that federal executive bodies authorized to issue authorization for creation of artificial land plots on waterbodies pertaining to federal property, located completely on regional territories and are used for potable water supply and public water supply, shall be Federal Water Resources Agency (except for harbours) and Federal Marine and Fluvial Transport Agency for harbours.

Article 69 shall be amended to add the following wording: “Separation distance shall ensure non-proliferation of fires from forest species in forest areas (forest parks) to edifices and constructions located: (a) outside forest area (forest park); (b) within forest area (forest park); and (c) from forest species outside forest area (forest park) to edifices and constructions”.
