Compensation for undeveloped commons held by communities with customary tenure rights

Compensation for undeveloped commons held by communities with customary tenure rights

This indicator asks whether national laws adopt VGGT principle 16.1 by providing compensation for undeveloped commons held by Indigenous Peoples and local communities. Principle 16. 1 of the VGGTs calls for States to resepect legitimate tenure rights by providing just compensation. Principle 9.4 provides that "where indigenous peoples and other communities with customary tenure systems have legitimate tenure rights to the ancestral lands on which they live, States should recognize and protect these rights." Answering the question posed by the indicator entailed reviewing a broad range of legally binding laws, regulations, and some court decisions at the national level.
