The Minister validates the methods of land rehabilitation of landscapes damaged as a result of subsoil management due to mining and extraction of minerals. It shall not be applicable to deep quarries subject to issuance of special permits for operation thereof. Land rehabilitation procedure must be performed by land owners and land tenants that have extracted common minerals on surface or near surface for their own individual needs. The following land categories shall be subject to land rehabilitation of disturbed land: (a) agricultural land; (b) waterbodies; (c) forestland; (d) wetlands; and (e) urban land. Land rehabilitation shall be performed with the consideration of the following indicators: (a) hydrogeological and geomorphological conditions; (b) depth of mining; (c) soil composition; (d) soil fertility; and (e) environmental heritage. Land rehabilitation shall be performed by means of technical and biological land reclamation.
