Law of 1997 on land fees.

The purpose of this Law is to charge citizens, business entities, and organizations with fees for possessing and/or using state-owned land, and to regulate the relations arising from paying the fees to the state budget. Land fees shall be charged for lands falling under the main classification of the unified land territory or special usage land specified in the Article 10 of the present Law and possessed or used by citizens, business entities, or organizations according to land possession and/or usage contracts. The document consists of 13 Articles.

This Order of the President made under section 19 of the Tribal Land Act, 1968, amends the Schedule to the principal Order by establishing the Mogoditshane Subordinate Land Board. As a consequence the Third Column of the Schedule of the principal Order is amended by deleting some territories listed under other Subordinate Lands Boards.

The objectives of this Act include: to protect the unique environment of the province, to provide effective means for resolving conflicts respecting land use and to provide the opportunity for public participation in the planning process. It consists of 47 sections and is divided into seven Parts. Part II is dedicated to provincial planning and related processes, Part III to municipal planning, Part IV to the enforcement of the Act, Part V to appeals and Part VII covers major retail development.

Immovable Property (Sale of Interests) Act (Cap. 60:01).

This Act provides for remedies in the case of disputes involving sale of an immovable common property that is undivided in shares. Any owner may request the Court to direct the sale of the property and the distribution of proceeds thereof. The Court shall have also discretion to direct a sale where sale is not requested by an owner of a moiety or upwards in accordance with section 4 (sect. 5). The Court may allow parties interested in the property to bid at the sale. Parties are allowed a partition suit. Section 8 regulates the relationship between this Act and other law. (10 sections)

Lands, Planning and Mining Tribunal Act.

This Act establishes and regulates the operation of the Lands, Planning and Mining Tribunal. Functions of the Tribunal include: to hear and make recommendations about objections to the acquisition of land under the Lands Acquisition Act, to hear and determine claims for compensation, to hear and make recommendations about applications for the grant of mineral titles, to hear and make recommendations about objections by registered native title claimants and registered native title bodies corporate to the doing of prescribed mining acts.

This Act, consisting of 206 sections divided into 14 Parts, provides for the appropriate and orderly planning and for the control of the use and development of land. Under the Act, a Northern Territory Planning Scheme has to be elaborated and implemented and the Act contains provisions on the application for and granting of permits and authorizations related to land development. The Act establishes the Development Consent Authority and regulates its composition and operation and provides for the solution of disputes that might arise from the implementation of the Act.

Mining Proclamation No. 68/1995.

The Proclamation shall apply to all mining operations, i.e. acts carried out to prospect, explore and mine for minerals within the territory of Eritrea. No person may carry out any mining operations without a license granted under this Proclamation. A person applying for a right must be eligible in accordance with section 5. Certain criteria do not apply to persons wishing to acquire an Artisanal mining right (as defined in section 2). Any Eritrean may prospect without a license on land not already subject to an existing license or application for a license.

La presente Ley de tierras baldías y ejidos establece que son baldíos todos los terrenos que no sean ejidos ni propiedad particular ni pertenezcan legítimamente a corporaciones o personas jurídicas, considerando también como baldíos, y la Nación entra desde luego a poseerlos, los terrenos ejidos que han quedado abandonados por la extinción, comprobada oficialmente, del dominio que en ellos ejercía el Municipio.

Under the Act, “settlement” includes “an instrument or instruments which under this Act or the corresponding previous enactments is or are deemed to be or which together constitute a settlement, and a settlement which is deemed to have been made by any person or to be subsisting for the purposes of this Act”, what constitutes a settlement is defined under section 8. This Act, consisting of 110 Sections divided into twelve Parts and completed by one Schedule, regulates land acquisition for public purposes and related procedures, up to registration. The Act also covers compensation and the methods for the payment of compensation and interests on compensation. The Act also provides for the resolution of disputes related to land acquisition and compensation.
