The purpose of these Regulations is, firstly, to remove initial afforestation from the planning control system, to coincide with the introduction of a separate statutory consent system by the Minister for the Marine and Natural Resources under the European Communities (Environmental Impact Assessment) (Amendment) Regulations, 2001 (S.I. No. 538 of 2001), and, secondly, to reduce the planning threshold for peat extraction from 50 hectares to 10 hectares.

These Regulations aim at the prevention of pollution of groundwater by substances listed in the Schedule and to control or eliminate as far as possible consequences of existing pollution. Regulation 3 excludes certain effluents and discharges from the application sphere of the Regulations. Regulation 6 concerns authorization of artificial recharges of groundwater.

Section 174 of the Town and Country Planning Act 1990 and section 39 of the Listed Buildings Act 1990 confers a right of appeal against an enforcement notice and a listed building enforcement notice on a person having an interest in the land to which the enforcement notice relates or is a relevant occupier. An appellant and local planning authority are entitled in any appeal proceedings to appear before and be heard by a person appointed by the Secretary of State but they may agree to the appeal being determined on the basis of written representations and supporting documents.

These Rules regulate the procedure to be followed for hearings in England caused by the Secretary of State to be held before he or an inspector determine appeals made to him against enforcement notices, listed building and conservation area consent enforcement notices and non-determination of applications for a certificate of lawful use development. Rule 4 provides for the preliminary procedure to be followed, in particular the information to be provided by the local planning authority, on receipt by it of a notice that a hearing is to be held.

This Act provides for the establishment of the Land Development Authority as a body corporate. It shall be the duty of the Authority to promote and assist the investigation, formation and carrying out of projects for the development, improvement and settlement of land. The Authority may establish a reserve fund. The Authority may make rules not inconsistent with the provisions of this Act.
