This Law, composed of 89 articles divided in 5 chapters, regulates the general principles on land rights. In particular, the Law rules on: property rights, rural community rights, natural resources’ use and protection measures, land expropriation, land concession, territorial planning, land classification, and registration procedures.

The Law of Property Act provides for real rights, their content, creation and extinguishment and is the basis for other laws regulating real rights. Real rights are ownership (right of ownership) and restricted real rights: servitudes, real encumbrances, right of superficies, right of pre-emption and right of security. The Law consists of 9 Sections that contain 365 Paragraphs. Section 2 (Chapterss 1 and 2, Paragraphs 32- 67) regards land register.

The purpose of the present Law is to regulate relations connected with establishment, payment and collection of dues. A trust of any interest in real property may be created to secure the performance of an obligation or the payment of any debt. The encumbrance of real property interests to secure obligations may be by deed of trust pursuant to the provisions of this Act. A transfer does not entitle the trustee or beneficiary to the possession of the property, except as provided in this Act. A deed of trust shall be created, renewed, modified or extended only in writing and must be registered with the Clerk of the High Court. Section 5 prescribes the procedure of registration.

This Act shall apply to any agreement, regardless of its form, which is intended to give rights in personal property, including houses on land not owned individually or entirely by the party or parties purporting to give an interest in the house, as security for the performance of any obligation. Such Agreements include, among others, pledges, conditional sales agreements, chattel mortgages, and leases under which ownership of personal property is to pass upon completion of the terms of the lease.

State Committee on Land Survey is a state institution responsible for the state and elaboration of the common state policy in the sphere of land relations and carrying out land reform. State Committee on Land Survey is authorized to carry out its functions directly, through its local branches and land-surveyors of local self-government.

Certificates of land tenure shall be registered in accordance with the projects of inter-economic land survey practice (submission of land-surveying materials on concession of the plots of land for determined purposes) validated by the Government, organs of executive power in accordance with the established modalities and their filling in shall be preceded by mapping of the boundaries of land tenure that is the ground for issuing certificate of land tenure.
