Administrative Measures for the Soil Environment of the Contaminated Land Parcel (for Trial Implementation).

These Measures are enacted for the purposes of strengthening the supervision and administration of the environmental protection of the contaminated land parcel and preventing and controlling the environmental risks in the contaminated land parcel. The Measures Consist of 33 Articles divided into 7 Chapters: General matters; Responsibilities of all parties; Environmental investigation and risk assessment; Risk management and control; Treatment and restoration; Supervision and administration; supplementary provisions.Suspected contaminated land parcel confirmed to exceed relevant standards of soil environment according to the national technical specifications is referred to contaminated land parcel. The Ministry of Environmental Protection shall implement unified supervision and administration of the protection of soil environment across the country. A holder of the right to use the land shall, under the provisions of these Measures, be responsible for carrying out relevant activities of the suspected contaminated land parcel and contaminated land parcel and the results of the aforesaid activities. Under the principle of “whoever pollutes the environment shall eliminate and control the pollution,” an entity or individual causing soil pollution shall assume the primary responsibility for the treatment and recovery.
