This Act provides for the bases and procedure for expropriation of immovables. This Act applies to all cases of expropriation of immovables unless otherwise provided by law. Expropriation is not precluded by provisions of law which prohibit or restrict the transfer or division of immovables or by the rights of third persons entered in the land register. An immovable may be expropriated in thepublic interest for the following objectives: (a) for construction or expansion of buildings belonging to the national defence, border guard, police, customs, custodial institutions, fire brigade and rescue services; (b) for energy production and construction or expansion of buildings necessary for energy supply; (c) for construction or expansion of public ports, airports and their servicebuildings; (d) for extraction of mineral resources; (e) for installation or expansion of lines; (f) for construction or expansion of public educational, medical and welfare institutions; (g) for construction or expansion of public streets, roads and squares; (h) for alteration or removal of buildings which substantially damage surroundings or scenery if the owner does not do so by a given date;(i) for creation of access to bodies of water, scenic points of interest, protected natural objects and cultural monuments and for ensuring preservation of such objects; (k) for establishment or expansion of cultural and sporting facilities, public beaches, tourist routes and recreation areas; (l) for establishment or expansion of cemeteries; (m) for establishment or expansion of public wastedisposal sites and buildings necessary for waste management;(n) for establishment or expansion of buildings necessary for water supply to public water catchments and reservoirs, and sewerage and water purification; (o) for construction of gaseous fuel installations; (p) for construction of pressure equipment and assemblies; and (q) in other cases provided by law. Expropriation is not permitted ifthe purpose for which expropriation is requested is achievable in another permissible manner. An expropriating authority shall pay an expropriation payment to the subject of expropriation upon expropriation of an immovable. An expropriation payment shall be paid in money unless the parties agree otherwise. An expropriating authority shall pay compensation to persons whose rights are damaged by anexpropriation.
