Administrator-General’s Act.

This Act: makes provision for the appointment of the Administrator-General for Jamaica by the Governor-General; defines functions and powers of the Administrator-General and provides with respect to the functioning of the Administrator-General and relevant judicial and administrative procedures, especially in respect of the administration of estates. The Administrator-General shall apply for letters of administration relative to the estates of all persons who shall die intestate and without heirs.

This Act makes provision with respect to matters of inheritance. It provides rules for the making and execution of wills and defines criteria for a will to be considered valid. A person may by will dispose of a contingent, executory or future interest in real property. Wills may be deposited with the Registrar of Probates and Administration.

This Act makes provision for matters of inheritance by will. It specifies the procedures and criteria for the making of a will and the effect of a valid will. A general devise of testator’s lands shall include leasehold as well as freehold lands.

This Ordinance concerns probate of will of a deceased person and the administration of deceased persons granted to an administrator by or without a will. Assets and liabilities of a deceased person shall be determined by the Supreme Court. The Court shall notify executors on probate of will and shall issue probate or letters of administration in accordance with provisions of this Ordinance. Unclaimed estate shall become property of the Crown. The Ordinance also provides for the division of intestate estates.

This Act concerns the making, revocation and effect of wills. Any person who has capacity pursuant to this Act to make a will may therein: (a) make provision for the transfer, disposal or disposition of the whole or any part of his estate; and (b) make provision for the custody or guardianship after his or her death of any of his minor children; and (c) make any other lawful provision, disposition or direction, whether in respect of his or her own or any other property or in respect of any other matter.
