These Regulations amend the Common Agricultural Policy Single Payment and Support Schemes (Cross Compliance) Regulations (Northern Ireland) 2005 in definitions and with respect to the Soil Management Good Agricultural and Environmental Condition requirement in the Schedule. They also make consequential amendments to the principal Regulations where references are made to the Council Regulation (EC) No. 73/2009.

This Decree establishes the modalities of cadastre valuation of agricultural land and updating its data related to plots of agricultural land allotted to agricultural organizations, including peasant farms and for subsistence farming purposes. Cadastre valuation of agricultural land shall be conducted on 1 January of the year of performance of cadastre valuation. Cadastre valuation of agricultural land shall be performed by initiative of State Property Committee at least once in 10 years.

This Decree establishes the modalities of cadastre valuation of agricultural land and updating its data related to plots of agricultural land allotted for urban and peri-urban agriculture to horticulture and gardening cooperatives, and also the land or urban areas. Cadastre valuation of agricultural land shall be conducted on 1 July of the year of performance of cadastre valuation. Cadastre valuation of the aforesaid land categories shall be performed by initiative of State Property Committee at least once in 4 years.

This Law, which consists of 8 articles, is codified to amend and add a number of supplementary provisions to the Law of 21 June 1995 on Preserving the Land Use of Farms and Gardens. The main rules of the afore-mentioned Law on Preserving the Land Use of Farms and Gardens remain unchanged and some detailed regulations have been amended or added by this Law. In particular, the Law adds 6 articles (articles 7 to 12) to the said Law. Accordingly, providing that any public service and infrastructure in farms and gardens may be allowed only after official authorization for land use change.

These Regulations establish an action programme for nitrate vulnerable zones, implementing the requirements to establish such a programme in Article 5 of Council Directive 91/676/EC concerning the protection of waters against pollution by nitrates from agricultural sources. Regulation 3 requires the occupier of a farm or livestock unit all or part of which is in a nitrate vulnerable zone to ensure that the action programme set out in the Schedule to the Regulations is implemented in relation to the farm or livestock unit or to that part of it which is in the nitrate vulnerable zone.

These Regulations supplement Council Regulation (EC) No. 2078/92 on agricultural production methods compatible with the requirement of the protection of the environment and maintenance of the countryside. They include provisions to meet the requirements of Commission Regulation (EC) No.746/96 laying down detailed rules for the application of the Council Regulation. Commission Decision C(99)15 of 29th January 1999 approved in part the agri-environmental programme entitled "the Countryside Management Scheme" to which these Regulations give effect.

These Regulations implement Commission Regulation (EC) No 1122/2009, which establishes cross-compliance requirements under Council Regulation (EC) No 73/2009. They set out the requirements for claimants of subsidy under the single payment scheme. The requirements are set out in Schedule 1, and Schedule 2 lists exceptions from those requirements.
