Regional Law No. 871-PK “On allotment of plots of land to multiple children family”.

This Regional Law establishes that plots of municipal land and plots of land with undelimited ownership shall be allotted to multiple children family in ownership free of charge and without sale for individual housing construction, suburban housing construction, subsidiary smallholding, farming, gardening, horticulture and stockbreeding. The aforesaid plots of land shall be allotted to families or single parents with three or more children of minority age. Minimum land area of plots of land shall be 0, 10 ha and maximum land area shall be 0, 25 ha.

This Regional Law regulates relations concerning ownership, tenure, management and disposal of agricultural land plots and agricultural land shares in common property. It establishes maximum and minimum land areas of the consolidated plots of agricultural land in case of allotment thereof out of stock of public and municipal land. Mass media shall have the duty to publish information related to turnover of the plots of agricultural land. The plots of agricultural land can be allotted to citizens for farming, grazing and haymaking, and other agricultural purposes.

This Regional Law establishes legal grounds for performance of subsidiary smallholding by citizens (natural persons) and state support thereto by state bodies and local government in the form of financial assistance for production of agricultural commodities and preferential taxation. Either urban land or agricultural land in the countryside, allotted to citizens or purchased thereby, can be used for subsidiary smallholding. Subsidiary smallholding shall include farming, gardening, horticulture and stockbreeding.

This Regional Law establishes minimum and maximum land areas of plots of land that can be allotted to citizens in ownership out of stock of public or municipal land for farming, gardening, horticulture, stockbreeding and suburban housing construction, including allotment of the aforesaid plots of land free of charge in cases envisaged by Land Code. Maximum land area that can be allotted for farming shall not exceed 10 percent of total available agricultural land area within the boundaries of a municipal unit at the moment of allotment.

The present Act is a piece of basic legislation that governs in matters pertaining to Indian status, bands, and Indian reserves. It has been suggested that the Indian Act provides ways of understanding native identity, organizing a conceptual framework that has shaped contemporary native life in ways that are now so familiar as to almost seem “natural”. This Regional Law regulates some issues in the sphere of land relations except for those related to agricultural land. It establishes minimum and maximum land areas for land plots pertaining to public and municipal land in ownership to citizens in accordance with the following criteria: (a) gardening – from 0, 05 ha to 0, 15 ha; (b) horticulture – from 0, 02 ha to 0, 10 ha; (c) for stockbreeding – from 0, 02 ha to 0, 10 ha; (d) suburban housing construction – from 0, 06 ha to 0, 25 ha; and (e) peasant farming – up to 75 ha, including agricultural land – up to 50 ha.

El presente Decreto aprueba el Reglamento a la Ley que tiene como objetivo su correcta aplicación para la preservación del uso de los terrenos dedicados a actividades de producción primaria agropecuaria, ya sea que estén inscritos o no en el Registro Inmobiliario, mediante una adecuada valoración para los efectos del cálculo del Impuesto sobre Bienes Inmuebles, en la que el uso del suelo y la producción serán factores determinantes para definir la base imponible del impuesto.

The present Act provides for the setting up of experimental farm stations which are scientific research centres that investigate difficulties and potential improvements to food production and agribusiness. Experiment station scientists work with farmers, ranchers, suppliers, processors, and others involved in food production and agriculture. Section 5 deals with land for tree planting and timber, and section 6 concerns the application of the Expropriation Act in respect of the acquisition and taking possession of land. The text consists of 10 sections.
