These Regulations make amendments consequential to the provisions of Chapter 6 of Part 6 of, and Schedule 13 to, the Localism Act 2011. The Act abolishes the Infrastructure Planning Commission and transfers its property, rights and liabilities to the Secretary of State. It also makes amendments to other aspects of the regime under the Planning Act 2008 for granting consent for infrastructure planning.

This Order amends the Town and Country Planning (Development Management Procedure) (England) Order 2010: in article 34 and Schedule 5 in relation with statutory consultees; in article 38 concerning application to a magistrates’ court for a planning enforcement order in relation to an apparent breach of planning control; by inserting new article 37A in relation to registration of development orders in the planning register maintained by the local planning authority.

These Regulations prescribe the procedure for applications to the Welsh Ministers under section 38 of the Commons Act 2006 for consent to carry out restricted works (as defined in section 38(2), (3) and (4) of the Act) on common land and certain related types of applications. The Regulations also provide for the management and determination of applications, including provision for representations, holding site inspections and hearings or inquiries in appropriate cases.

This Order prescribes for England the procedure for applying for and issuing certificates as to appropriate alternative development under section 17 of the Land Compensation Act 1961. Where an interest in land is proposed to be acquired by an authority possessing compulsory purchase powers, either of the parties directly concerned may apply to the local planning authority for a certificate under section 17.

These Regulations make provision regarding the making of tree preservation orders under the Town and Country Planning Act 1990, which protects trees in conservation areas. They, among other things: prescribe the form of tree preservation orders and the procedure for their making, provisional effect, confirmation, variation and revocation; set out prohibited activities in relation to a tree protected by an order; and provide exceptions.

These Regulations concern compensation in the case that a planning permission granted by a local planning authority is subsequently revoked or modified, or planning permission granted by a development order or a local development order is withdrawn. The Regulations make amendments, in respect of Wales, to section 108 of the Town and Country Planning Act 1990, regarding conditions for entitlement to compensation.

This Order makes transitional provision in relation to sections 21 and 22 of, and Schedules 2 and 3 to, the Localism Act 2011, which inserted new Part 1A into the Local Government Act 2000. Part 1A replaces Part 2 of the Local Government Act 2000 so far as it relates to local authority governance arrangements in England.
