La presente Ley declara de interés nacional la promoción del acceso a la propiedad formal y su inscripción registral con el fin de garantizar los derechos de todos los ciudadanos a la propiedad y al ejercicio de la iniciativa privada en una economía social de mercado, y crea la Comisión de Formalización de la Propiedad Informal (COFOPRI), como organismo rector máximo encargado de diseñar y ejecutar de manera integral, comprehensiva y rápida un programa de formalización de la propiedad y de su mantenimiento dentro de la formalidad.

Decreto Supremo Nº 009/99/MTC - Aprueba el Texto Único Ordenado de la Ley de promoción del acceso a la propiedad formal.

This Law aims at regulating land survey and land registration. This Law is composed of 8 Chapters divided into 79 articles. Chapter 1 deals with Sheets and authoritative entry. Chapter 2 provides for land ownership rights. Chapter 3 refers to disposal of land rights to be recorded in the Land Register. Chapter 4 provides for: registration procedures in the Land Register; announcements and objections; and legal proceedings for confirmation of ownership. Chapter 5 pertains to ownership document.

The purpose of this Decree is to regulate land survey and land registration by establishing the Land Survey and Registration Bureau. The present Decree is composed of 7 articles. Article 1 provides for the establishment of the Bureau. Article 2 deals with the nomination of the President of the Bureau. Article 3 specifies the functions and duties of the Bureau. Article 4 defines the internal organization of the Bureau. Article 5 entrusts the Prime Minister with the issuance of a resolution for defining the tasks of the departments that compose the Bureau.

Ministerial Decree No. 958 on keeping land cadastre.

This Ministerial Decree establishes the modalities of keeping the state land cadastre, land registration and granting access to information thereof. The purpose of keeping the state land cadastre shall be to provide the state institutions, natural and legal persons with general information on land and on particular plots of land. Registration and storage data unit shall be the information on a single detached plot of land. The cadastre shall contain data on landowners and land tenants.

The present Regulation implements the Contaminated Sites Remediation Act (Chapter C-205). In particular, it deals with definitions, site registry, expropriation, determination of hearing costs incurred by the Commission. One Schedule is enclosed concerning eligible costs of commission hearings.

Antigua and Barbuda Survey Act (No. 2 of 1945).

This Act grants powers to surveyors appointed by the Governor-General for purposes of this Act, imposes certain duties on such surveyors and provides for compensation of damage incurred in relation with surveys carried out under this Act.The surveyors appointed under this Act are granted the power to enter upon any land for the purpose of making any topographical, geological or hydrographical survey and to do all tings as may be necessary for such survey. A surveyor shall give a notice to landowners owners prior to survey.

Land Adjudication Act (Act No. 16 of 1975).

This Act sets out the procedures, principles and criteria for the adjudication of land in an area declared to be an adjudication area by Order of the Minister made under this Act. The Act also declares all waste and unoccupied land to be Crown land.The Minister shall appoint an Adjudication Officer who shall be in charge of the adjudication of land in the area. Every person claiming an interest in land in the adjudication area shall observe the procedures and criteria as laid down in this Act.

This Act lays down rules for the licensing of surveyors and the carrying out of land surveys of public and private land and provides for the appointment of a Chief Surveyor and the establishment of the Land Surveyors Board.The Chief Surveyor shall direct and control all public surveys, shall prepare and make public official maps and shall control all plans of surveys before registration of land. The Board shall be responsible for the granting of licences for the practising of land surveying and for the registration of licensed surveyors.
