Spain ceded Guam to the US in 1898. Captured by the Japanese in 1941, it was retaken by the US three years later. The military installations on the island are some of the most strategically important US bases in the Pacific.


Guam is a presidential democracy. Guam is a self-governing unincorporated territory of the US.

Servitudes - Chapter 7 of 21 GCA “Real Property”.

This Chapter defines and classifies servitudes and defines rights and obligations deriving from such land burdens. Easements, i.e. servitudes attached to land include: a) the right of pasture; (b) The right of fishing; (c) the right of taking game; (d) the right of way; (e) the right of taking water, wood, minerals, and other things; (f) and the right of having water flow without diminution or disturbance of any kind. Servitudes not attached to land include the right to pasture, and of fishing and taking game (sects. 1 and 2).

This Chapter concerns the recording of conveyance of real property and the effects of recording. The term conveyance embraces every instrument in writing by which any estate or interest in real property is created, alienated, mortgaged, or encumbered, or by which the title to any real property may be affected, except wills. Every conveyance of real property acknowledged or proved and certified and recorded as prescribed by law from the time it is filed with the Director of Land Management is constructive notice of the contents thereof to subsequent purchasers and mortgagees.

This Chapter establishes a Commission on Decolonization for the Implementation and Exercise of Guam Self-Determination for the Native Inhabitants of Guam and defines its functions and powers and internal organization. The Commission shall be instrumental in the process of succession in colonial power by the United States over the lands and the people of Guam.

Public Law 29-135 - An Act to renumber §60907 and to add a new §60907 to Article 9, Chapter 60 of Title 21 of the Guam Code Annotated, relative to the Department of Land Management Building Construction Fund.

This Act amends the Land Management Act for purposes of authorizing the Department of Land Management to provide for the design, construction and collateral equipment of a new public facility and to arrange related financing.

This Chapter regulates the practice of real estate valuation, defines the powers and duties of real estate appraisers and provides for their licensing and certification.The Chapter provides stricter rules and standards for the assessment of value of real property in Guam so as to provide a basis for loans secured by a mortgage. Carrying out an appraisal activity in Guam requires a licence to be granted by the Director of Revenue and Taxation. The Director shall maintain a register of persons certified under this Act.
